Yes, correct, this was the defence,0

OK, so spend a day or two scrutinising their evidence:
- did the NTK have the POFA wording and was in posted in time?
- were the signs contemporaneous (BPA logo from then, not IPC)?
You'd be looking for grounds to appeal that the Judge erred on quantum and the POFA, I suggest, if you can find the NTK was non POFA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ok - I will do this depending on the decision of the judge.
I am just curious as to why the set-aside wont be successful? Because the Claimant got the court date and I didnt? Surely I am not the only one this has happened too, either it it got lost in the post or my neighbours threw it away.
Hopefully the judge can see some sense.0 -
There's a chance the judge "sides" with the view that you ",chose" to ignore the hearing
But no point worrying till you get a reply to your letter.0 -

Yes, but this makes no sense, especially when I rejected the Claimants request trial by letter and I wanted my day in court. I should have mentioned this in my letter but told it was 'waffle' lol.
Will wait and see what happens, fingers & toes crossed.0 -
There was no point arguing with the support staff
You should have just been asking it to be in front of the judge ASAP0 -

When I say argue, I wasnt screaming & shouting, I was polite and respectful.0 -

My post #55 that you replied to as above was in answer to this question you asked:
I am just curious as to why the set-aside wont be successful? .
And not intended to worry you unnecessarily!0 -
The point being you need staff like that on your side to put the paper work in front of the judge asap0

Ah thank you - She could understand my concern and agreed she would expedite it when she gets the chance. I said I will chase again tomorrow. Will keep everyone updated.0
