Hi Folks
I recently had a car service and borrowed a courtesy car from the mechanic. I went to the supermarket and by habit entered the reg of my own car not the courtesy car. The mechanic received a ticket a few days later and is presently sitting on it till I get back to him. Not sure of my best course of action could anyone advise please?

Hi Folks
I got a ticket from Euro Car Parks a few weeks ago.! I came to this website and you referred me to the newbies section.! I put together an appeal from this info the best I could and sent it off electronically to them but they refused the appeal.!I( am having trouble posting my appeal and their refusal so I am going to try to split them.) I would appreciate any help anyone could give me on what I should do next.

I challenge this 'PCN' as lessee of the car and subsequently request all future correspondence be sent directly to myself at the address listed below:

I am the vehicle's hirer and keeper for the purpose of the corresponding definitions under Schedule 4 of the Protection of Freedoms Act 2012 (POFA) now it is proven that in this instance, the registered keeper is not the "keeper" (as defined under POFA), Civil Enforcement has no reason to contact
Garage Limited again regarding this PCN.
Appeal as follows:

1. I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers.
Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.!
There will be no admissions as to who was driving and no assumptions can be drawn. You must either offer me a POPLA code or cancel the charge.
2) Breach of the BPA Code of Practice Principles
Under section 21 of the CoP, AOS members are only allowed to use ANPR if they:
(a) Use it to enforce parking in a reasonable, consistent and transparent manner.!
(b) Have clear signs which tell drivers that the operator is using this technology and what the data captured by ANPR cameras will be used for.
21 Automatic number plate recognition (ANPR) General principles
21.1 ''You may use ANPR camera technology to manage, control and enforce parking in private car parks, as long as you do this in a reasonable, consistent and transparent manner. Your signs at the car park must tell drivers that you are using this technology and what you will use the data captured by ANPR cameras for.''
The facts are that a ticket was bought, and that the driver had paid in good faith but had simply keyed in the wrong registration number. This is not mitigation, this is a fact that I submit cannot give rise to a PCN because it is not 'transparent' in the terms on signs/the P&D machine, that a correct VRN is an 'obligation' which runs such a risk and will be compared to the ANPR data for the purpose of imposing a charge.
The fact is, a BPA AOS operator is required to have transparent, fair and professional procedures including manual checks to identify such minor infringements. I require that the operator provides me with a copy of their policy and proof that those checks were made in this instance. Further, I require proof that ''wrong VRN' is in fact incorporated into the contract from the landowner as a penalty-generating 'contravention' since I find it highly unlikely that the retailer/landowner allows this unfair fining of paying customers,! (the retailer/landowner has been contacted regarding this affair as has my local MP), If it is not in the contract it is not a contravention that can give rise to a penalty.
