CHAPS payment sent to the wrong account

    I spoke to the person involved this morning and she admitted she looked at the form on the Thursday but wasn't sure of one of the numbers because of my handwriting so she asked a colleague what it looked like and they effectively took a punt. She did say she wished she had phoned me up to check


    And may thereby have shot the firm in the foot.


    Let's say the last two digits of your account number were 71 but your poor writing of the figures could be read as 17.

    If the clerk had not had any doubt (or if she had, had not admitted it), then it could be quite difficult to prove any liability for the error lay with her.

    However, the doubt has been admitted ( was the conversation recorded?) and in these circumstances, not checking the figures before sending the payment was irresponsible to say the least?
  • I'll wait until it's all sorted then maybe suggest they change their procedures. Coincidentally I've just won a compensation claim with another solicitor and they rang me up to check bank account details to send the payment and said they do a confirmatory call as a matter of course
