Developer trying to charge for optional extras from a previous reservation

Looking for some advice. We reserved a new build house back in January which fell through due to our buyer pulling out last minute. The reservation was cancelled by the developer, all our money refunded that we paid for reservation and optional extras.
We re-sold within a couple of weeks and rereserved the same new build plot in May. New reservation, new contract and having to start the process again.
Have received a call from the sales office this morning saying that they need to take the payment again for the optional extras.
IMO, they cancelled the initial contract and refunded my money and therefore the new reservation forms new contract and we are taking the property with whatever has already been picked (granted it was us who picked them but if it wasn’t us who previously reserved it would have been options we didn’t pick).
Can you let me know your thoughts on this and what you would do if in this situation?
Feeling a little frustrated as they didn’t mention when we re-reserved that they would charge for these again.

  • I believe it would be too late now to change, the build is due to complete July/August.
  • New contract is just new reservation agreement and doesn’t mention about what optional extras have been selected already nor that there are any even included to be honest. We just know they are included as it was us that previously picked them on the reservation from Jan.

    You pay the same as what you paid and they refunded last time (unless you explicitly negotiated something different). You don’t pay for the extras twice.

    So you genuinely think you should get thousands of pounds worth of options for free because you dropped out last time ?.
    How would you feel if they refused to sell you that one but let you spec up another one ?

    You should only pay for what you have selected. The previous reservation dosen’t matter. If they are already installed then you have no option but to have them then the house should be sold as seen

    So your new contract does not state what you will be paying and what is included?

    Are you ok with the developer withdrawing or decided to take out your upgrades, put them in a similar house and give you the basics? Or are you going to pay for what you ordered?
