TPS Appeal

Hi All,

Asking for a friend :) who has received a parking charge in the post, for overstaying a free 30 minute parking period.

The friend used the template parking letter and has had the below response back.

I would say the signage was poor, one sign as you go in and on the back of it the parking charges for a whole car park. Also I think the £60 sum is not really fair based on the £3 charge for 30 mins - 2 hours or £6 for 2 - 4 hours.

I guess the next step is a POPLA appeal?

Thank you for your correspondence, the contents of which have been noted.
The Parking Charge Notice was served under Schedule 4 of the Protection of Freedom Act 2012. Since
your appeal appears to be a vague internet template without giving any mitigating reason, we are
limited with what we are able to respond.
We duly enclose images of the vehicle and signage.
The vehicle was parked for over 2 hours without authorization or payments.
A grace period applies of 10 minutes.
The site does not operate PDT Machines nor that it would make any difference.
The reason for the PCN is clearly explained in our correspondence dated 05-04-2019 and 23-04-2019.
Unfortunately, after careful consideration your representation has been declined. It follows therefore,
that the Parking Charge Notice was correctly issued and the discounted amount of £60 remains
outstanding. You have now reached the end of our internal appeals procedure and you have a number
of options;
1. If you were not the driver, provide the driver full name and serviceable address within 28 days of the
date of this correspondence.
2. Pay the Parking Charge Notice within 14 days at the prevailing price of £60 by 05/06/2019. Please
note after this date, the full charge will be due at £100 and must be paid by 19/06/2019. Payment can
be made online by visiting https://www.totalparking.co.uk/payment or via our 24 hour telephone line 01536
680107. Payment can also be made by post to TPS UK, PO Box 7135, Kettering, NN16 6BP.
3. Make an appeal to the Independent Appeals Service (POPLA) within 28 days (by the 19/06/2019) by
visiting https://www.popla.co.uk and use the following verification Code XXXXXXX to submit your appeal.
Please be advised that if you choose to have independent arbitration of your case, and your appeal is
declined, then the Parking Charge will be due at the full amount of £100
If you choose to do nothing, we will seek to recover the amount due via our debt recovery process,
where additional costs may be incurred.
By law we are also required to inform you that Ombudsman Services (https://www.ombudsman-services.org/)
provides an alternative dispute resolution service that would be competent to deal with your appeal.
However, we have not chosen to participate in their alternative dispute resolution service. As such
should you wish to appeal then you must do so to POPLA, details on how to are explained above.

    It would be better for your friend to come here rather than use you as a third party intermediary.

    We need to know whether there was a NTD or not, and the dates of the alleged event and the date the NTK arrived.

    Yes to PoPLA. Use all the relevant appeal points available from post 3 of the NEWBIES.

    Your friend needs to get their own pics of the signage and to check whether the PCN is PoFA compliant or not.

    Unfortunately my humour was missed slightly, The ticket came to *EDITED*

    There was no NTD on the ticket, I will reply with the additional info when I get home later. I will read up on the points for appeal.

    Throughout here you are advised never to reveal who was driving

    You need to edit your post to remove details of who was driving

    The ppcs monitor this forum and can use posts in your thread against you

    Nine times out of ten these tickets are scams so complain to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

    As above, you need to edit your post urgently to remove information about who did what. The two posts together have identified the driver. You need to edit one or both.

    It is better to only refer to The Driver and The Keeper, who are two different people. ;) So this before you do anything else. Parking scammers monitor this forum.

    The NTK arrived on the 8/4/2019, I could ask for and upload a copy of the NTK with any personal information blanked out? along with pictures of the signage.

    I have acquired some pictures of the signage on site, One is at the entry point but and the other is near by after you enter but it is not clearly visible at all.

    You come across as a bit aggressive towards me ....

    I edited it as a precaution but I don't think I revealed who was driving the car?

    I am appreciative of any help with this don't mistake me!
