Return postage for faulty goods

I am returning an item that was working and has become faulty and the company have asked me to send the item back to them.
I no longer have the original packaging but I know that doesn't matter if the item is faulty.
They haven't mentioned paying the return postage and although I don't know yet how much it will cost me, it's not a small item do will likely cost a few pounds.

They say they will inspect it and if I'm right, will send me a replacement - which I'm happy with. Their returns policy doesn't mention postage for faulty returns. Who should pay?

Their returns policy is a cop out. It gives less protection than your statutory rights and therefore may amount to a criminal offence.

Have you asked them to provide a prepaid label and reminded them that they are liable for return costs of goods that do not conform to contract? When did you buy it?

1.1 If the goods we deliver are not what you ordered or are damaged or defective in any way or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us by e-mail (admin@powerbee.co.uk) or phone (0845 094 8821) of the problem within 7 working days of the delivery of the goods in question.

1.2 if you notify us of a problem under condition 1.1 you must return the goods to us or you will remain liable for their cost. Unless otherwise agreed, you are liable for the cost of returning the goods.

1.3 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition, and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause 1.1 above.

If the goods were delivered then you can ask them to collect - at their cost. You only need make the goods available at the place you took possession.

When did you buy? How did you pay?

I suspect they will try to make you pay for postage ....

I've used them before several times with no problems.

I bought the item (a solar powered pond pump) last September but only installed it three weeks ago. It worked for a few days and then stopped. I think it's a problem with the battery.

Okay so they have referred me to their terms and conditions.

Should I just pay the postage?

it depends if you're wanting to return them under their terms/warranty/guarantee or exercise your statutory rights.

6 months since purchase, I'd probably pay along and pay the postage for the sake of a few quid. They may refund you if they find the item is indeed faulty.

I posted it first class recorded. It was £6.50. Not so bad as the pump was£70.

Let's see if I get a replacement without a quibble.

    Update:

I posted the faulty pump back and received a replacement in the post this morning. Can't complain about that, really.

Offering a premium rate number starting 084, 087 or 09 is quite simply illegal and the regulations require that the call charges are refunded to the caller. The regulations came into force almost five years ago, on 13 June 2014.

Additionally, failing to state the call charges alongside the premium rate 0845 number is a breach of Ofcom regulations in force since 1 July 2015.
