CCJ issued by Excel at my place of work!, options for getting it set aside?

Who filed another CCJ, only a court can do this. Did you ignore or not receive court papers? Did you at any time tell the DPO at the PPC of your proper address for service and tell them to ERASE your old address? If so and they still sent post to your old address, a complaint to the ICO is in order.
It's excel parking, it's for another allerged parking charge.
What's the DPO and PPC?0 -
Local court has been contacted and they are trying to ask a judge if both cases can be heard in one hearing, it just highlights the fact that excel are completely abusing the system and not using correct address details, they've literally just copy and pasted the first claim and not even bothered to check the address details are correct.0

For set asides it is always a local court, as thats where the hearing is at.
You may be asked to make a formal applicaiton, which costs you, but you can ask that they use their inherent case management powers
You need to major on this HEAVILY - that the claimant *knowingly* issued two claims when they were only entitlled to one, and therefore the ENTIRE second claim is an abuse of process, for which the usual sanciton is to stirke the WHOLE CLAIM OUT.0 -
Hi Nos,
My assumption is that the two Claims will be for two separate "parking charges".
I can still use the fact that they've sent the second one to the wrong address again when my details are correct with the DVLA though right?0 -
Depends if the keeper address at DVLA was correct at the time of the application (shortly after the parking event)0

Yes, but if they are for the same car park then they should have been raised together. they know this. They dont, because they make more money raising them separately (and its easier to manage)Hi Nos,
My assumption is that the two Claims will be for two separate "parking charges".
I can still use the fact that they've sent the second one to the wrong address again when my details are correct with the DVLA though right?
IF and ONLY IF that reason is correct of course! Only you know if that is true.
Id imagine you can copy and paste basically all of your current set aside WS etc IF you need to have a whole new hearing solely for this new one.0 -
Hearing has been brought forward to Thursday next week (25th)
Currently sending second set aside through.0
