Because it keeps the LOOOONG argument (post #14 of the Abuse of Process thread by beamerguy) and exhibits about the fake added £60 and the Consumer Rights Act, separate and easier for the Judge to follow. You want the Judge to find your file easy to read and find page numbers and exhibits in it (include a contents page too).but why the seperate WS?
And it should in theory make it easier for you to come to as a separate matter in court, and it avoids making your 'story' main WS (about the £100 charge) ten pages long!
It's not just that, it's the entire thing is objectionable as a document, but the misspelt name proves the ex-police Director cannot in a million years have written or signed it.However I do want to point out that the mispelling of his name cannot be a typo.
Just put the SRA complaint email in as evidence and put a line or two about the WS being a 'false instrument' full of legal argument and no substance, and currently the subject of an SRA investigation into Gladstones fielding WS they've written themselves that cannot possibly have been actually checked, written or signed by the supposed 'witness'.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi all,
Nearly at the finishing line and will be soon ready to submit my WS bundle to Gallstones. I recently had mine removed and I can only hope this case helps towards the removal of these coyboys.
I'm feeling confident but have a question.
Gladstones dont seem to have a specific email of which to receive WS bundles. Would emailing all email addresses I have thus far been seen as a !!!! move?0 -
WS Bundle has been sent off to Gladstones via enquiries@gladstonessolicitors.co.uk seemingly without a hitch. I've just got to print off a binded copy for the court and hand deliver it myself tomorrow.
A large weight has been lifted on my shoulders here. I'm confident there are several compelling arguements to be made and my bundle is a million times better than Gladstones. While it's not quite over yet, I've got a long, near 5 month wait until my court hearing.
My plan is to submit my costs schedule imminently unless you would recommend a week or so prior to the hearing and also compile my skelly arguement soon-ish, as I'd like my evenings back for a bit.

Your costs schedule should have been submitted along with the WS plus Exhibits , all one bundle , so get it done and submitted asap , certainly get it done and submitted a fortnight or more before the hearing
Get the skelly done whilst it's all fresh in your mind , it's an aide memoire , concise , no additions , no new evidence or points , it won't be fresher in 5 months time than it is right now0 -

As an update, I received a call / email regarding settlement. Down to £100 from £280+. I declined. I've still several other PCNs for indentical circumstance and would rather have my day in court.
One question I do have... I made a good case in my WS for considering all PCNs as they're identical in circumstance bar the date. If Gallstones withdraws, that arguement wont be be considered before a Judge. Tough luck, rinse and repeat or can I write to the courts asking for a judgement on that along with costs etc?0 -
