Refund for car seat

Hi,

I purchased a car seat (brand new from retailer) on 29/04/19. Installed and used once. Daughter was 'flopping' in it so rang retailer (facetime) for advice. They said it was fitted correctly. Problem persisted so I paid an independent, registered car seat professional to physically check it. They said the fit in my car was 'ok but not perfect'. Returned car seat. Retailer now saying they will only partially refund me as it is outside their 7 day return policy and has been used! (I explained I went away 2 days after purchasing and then was in hospital very ill so seat had not been used) Even with me quoting CRA and SADFART rules (not fit for purpose) they're not budging!!

    *note* I explained to them on Saturday that I had been away/in hospital hence ot being outside the 7 day period and they agreed it was fine, given the circumstances. They are now using this as a reason for a partial refund!

    It isn't faulty, your own independent expert says that, and so you don't have the right to any refund at all.
    (Although I could be wrong, I often am.)

    When you purchased it, did the retailer check that it fitted correctly in your car? (If they offer this service)

    If they did, then I would push for a fill refund.

    If you didn't ask for the retailer to check it fitted properly (if service offered), then as it is not faulty, no refund is due. (So take the partial refund).
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    If you buy a britax car seat you can use the fit finder to find a seat that's compatible with your car

    Have you checked with the manufacture if the car seat was a match in the first instance.

    Before purchasing, I did ask the retailer and they said it should fit in my car no problem. But I had to have the seat so upright, it caused my daughter to flop forward, to the point her head was between her knees when she fell asleep, which is dangerous. The independent expert I had look at it said the only way round this was to roll up a towel and place it under the seat, which is not what I paid almost £200 to have to do!

    How old is your daughter?

    Does the seat not have straps that go over her shoulders to restrain her?

    As already advised, bite their hands off for the refund... ultimately you have no rights to a refund based on the scenario you are suggesting, you are ultimately relying on their goodwill (keep in mind this can be quickly used up)

    This not fit flopping about is it due to the seat being to big ??


    Is this a seat for your car and the childs size or just a seat you choose .( as per Pinkshoes reply )

    Presumably the seat complies with the relevant safety standards so is "fit for purpose". It's just not fit for your purpose - fitting your car and your child. It's like buying a pair of trousers that are five sizes too big and then claiming they're not fit for purpose because they fall round your ankles.
