Parking Charge Notice received in post

We have had a PCN from Civil Enforcement. We have a ticket more than covering our time in the car park; the only potential reason I can see for its having been sent is because we were recorded entering at 13:18:52 and the ticket was printed at 13:29 - the bank holiday caused rather a queue at the ticket machine. Can this be quashed easily?

Of course, as per the NEWBIES thread, send the usual template online to CEL.
Meanwhile also complain to the retailers, but the sticky thread tells you that too!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

“Payment not made in accordance with terms displayed in signage” is the exact wording. It has to be the 8 second overdue printing, doesn’t it? The expiry of the ticket was 23:59 and we left around 1930 so I cannot fathom any other reason for the charge. Given that it was a busy bank holiday one would hope that some clement may be applied to the grace period.0

parking companies are greedy pirates and not known for clemency
the BPA CoP January 2018 edition details grace periods in clause #13 , please download it and read it
then do as mentioned above and appeal as KEEPER using the blue text template , unchanged
no blabbing about who was driving0 -
Read the article by Kelvin Reynolds of the BPA, about observation periods being not a set time, and could be 5 -10 mins or more, due to 'various factors'. Google it and use that article in your favour at POPLA.
You can find previous threads about it by searching this forum for obvious keywords:

Don't give away at appeal who was driving, and no choosing 'driver' on the appeals menu.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

This is very informative, thanks. Should I not include Kelvin’s excellent work in the appeal text, then?0

I meant more the law if it were to go to court seeing the 8 seconds as worthy of being overlooked. Even more so having learned that these are legally questionable in themselves.0

Not at first stage - no point. The PPCs don't read it. The idea of the template appeal is twofold:
- a stepping stone to POPLA stage when you can use your evidence
- a message is sent to the PPC who recognise the appeal and sometimes give up as they know you are here and won't name the driver.
CEL do sometimes fold when they see the forum template, so no changing it.
If this goes to POPLA you will win if you explain the in/out grace periods well.
Here is how I suggest people set that POPLA appeal point out:

A grace periods point re:
(a) arrival time, and why it took 10 mins, explaining the queues/Bank Holiday, and
(b) leaving time, where you'd point out this and embed a scan of the ticket:We have a ticket more than covering our time in the car parkPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have sent the template verbatim. Am I right I’m thinking that if we hear nothing with the 14 days as set out then it can be forgotten? Will we receive a reply either way? And, finally as a point of interest - why is the driver never to be named in such happenstances? Many thanks0
-
No, there is no 14 days in play! PPCs have some 35 days to respond.BernieCrumbles wrote: »I have sent the template verbatim. Am I right I’m thinking that if we hear nothing with the 14 days as set out then it can be forgotten?
l already pointed you to the next stage appeal:

Does the retailer/authority responsible for the car park have the power to cancel the PCN directly? Is it worth sending a blistering Facebook message to communicate my ire at attempt to fine the 8 second flouting of the grace period?0
