If you had answered KeithP’s question in post #2 on 11/05, he would have explained precisely how you avoid this in his almost immediate response.
Regulars don’t ask random, pointless questions, they are asked with the express purpose of helping you. We have so many to help, not responding to questions moves regulars on to other cases very quickly.
Apologies for this. I was just a little embarrassed about not posting sooner. I will send off my defence and then let post about what happens next.0 -

I am going to assume you did the Acknowledgement of Service before Monday 29th April. Please confirm. It was issued on the 10th April. I have done these AoS to extend it 28 days.
With a Claim Issue Date of 10th April, and having done the Acknowledgement of Service in a timely manner, you have until 4pm on Monday 13th May 2019 to file your Defence.
That's today!! You have precisely two hours to file your Defence.
When you are happy with the content, your Defence should be filed via email as suggested here:-
Print your Defence.
- Sign it and date it.
- Scan the signed document back in and save it as a pdf.
- Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
- Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
- Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
- Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
- Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.
0 - Sign it and date it.

Hi Keith,
I got it in on time. I now have a without prejudice letter from parking eye saying they have new information and they want to bring the matter to a close without further cost. They are now asking for £60 down from the original £175.
From reading on the forum, should I pursue them and ask them to disclose what new information they have received? Where would this potentially lead?
If this is their last ditch effort to extract cash out of me before capitulating, should I invoice them for my costs? :rotfl:
Best,
K0 -
To add more info, I asked the land owner to cancel the ticket and they have emailed me a couple of times to say that they have asked parkingeye to do so.0

I also corrected the defence as suggested by coupon.0

any advice would be appreciated. They have given 14 days to reply.0

Yes, tell them if they've received 'new information' then it must include your personal data and so you want to see it, as is your right under a SAR.From reading on the forum, should I pursue them and ask them to disclose what new information they have received?
They are likely to give up, I expect, as they'd have to show you that the landowner doesn't support the case. Blows their 'legitimate interests' story out of the water!Where would this potentially lead?
LOL, you can if you like. But I would actually offer them £6, also on a WP basis, as you are aware they have NO legitimate interest but you were always prepared to pay the £6, it was just ParkingEye's fault they hid the unexpected keypad & terms out of plain sight:If this is their last ditch effort to extract cash out of me before capitulating, should I invoice them for my costs?
Expect them to reject it of course but it's a 'slow & steady wins the race' chess move; it puts them in a worse position than they want to be in, when it comes to the question of costs if a hearing occurs.I parked at a hotel for an hour and didn’t see the signs requiring a fee. I entered the hotel and had a meeting and left. There was a ipad device in the hotel that I couldn’t find that needed my vrn and £6.
I think an offer of £6 then SILENCE from you, when they bleat and want more, will cause them to finally fold.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks Coupon.
I will ask them for their further information.
Is there a template for a WP £x offer email that I can use? It would be great to add a “WP offers to settle” in a sticky thread as this must happen quite often for people who defend with the excellent advice offered on this board.0
