STARPARK/Phone and Pay/Civil Enforcement LTD

Hi MSE, I was hoping to get some advice in dealing with several parking parties.

Received a PCN from "Civil Enforcement LTD" for a parking contravention in a parking area managed by "Starpark" using "Phone and pay" services?


Parking was obtained over the phone. I have evidence of:
  • Phone call to phone and pay
  • text to confirm number plate (No responding message of confirmation)
  • Money payment referenced to "Phone and Pay"
  • Text from Phone and pay, informing me of my expiring allocated parking period.


Just looking at the shambles of how dodgy the PCN letter looks, let alone the name of the company "Civil enforcement LTD".

    They are obviously trying to scam you so complain to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.

    Until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

    I am unsure exactly what refers to POFA wording, it does state "This notice is issued under schedule 4 of the protection of freedoms Act 2010"

    I have read through Schedule 4 as provided by the "Newbie thread". I have understood that they should specify the period of contravention, which would potentially be the period before paying for my ticket. However, they have indicated the entire parking period.

    It states, "It is the driver's responsibility to pay", "notify the name of driver", "Appeal in wiriting within 28 days", @e have photographic evidence".

    There is no specific reference to "keeper liability", would this make the PCN Non-POFA compliant?

    It is the POFA 2012, assume that was a typo on you behalf.

    They did use POFA wording on the back, as CEL now do.

    Civil Enforcement Ltd are the same as "Starpark", a trading name.

    I guess you must have paid for the wrong vehicle recalled from a previous parking session, or made a typo in the VRN when registering to park, or overstayed?

    Submit the NEWBIES template. There's no need for a thread at this stage.

    I can confirm I used the correct registration, I had a text later in the day as a reminder that my allocated parking was due to expire at 18:32, which included the correct registration.

    The PCN has me recorded leaving at 17:19. I have realised that parking terms require paying for parking within the first 10 minutes, which, unfortunately, I did not.

    I arrived at 8:03, did not pay till 8:33. My parking was valid from 8:33 to 18:33.

    What are my options? Is there a chance of appealing in a sense of. I have paid for 10 hours stay, I left with 1 hour and 10 minutes prior to my allocated time. Would it be possible to wave the 30 minutes I stayed prior to paying for my parking?

    for now the questions are irrelevant, you appeal with the blue text template as KEEPER, no changes

    The appeals form requires me to answer if I am the driver and requires the input of my full name & contact details.

    do not reveal who was driving, appeal as keeper


    if the online system wont allow it , do it by post as KEEPER and get a free certificate of posting from the P O Counter (not signed for and certainly only pay for the stamp, nothing else)

    My appeal has been unsuccessful; a POPLA verification code has been provided. The allocated time for internal appeals procedure has ended.

    My time allowance has been extended to allow payment of the original "Reduced fee".

    What are my options now?
