But in order to transfer liability back to the driver, you need "to notify the creditor of the name of the driver and a current address for service for the driver".
I am not sure an email address would be acceptable - especially in this instance, as it gives no clue that the driver lives abroad.0 -
oh yes! I should have made that clear... Name , address, phone number and email address has been provided. They can now battle it out. They can send correspondence via expensive couriers for all I care!0

I am not sure he will want to provide his passport details and I would want to ask given that he is going through a messy divorce at the moment. I can't imagine adding this on his things to do. Do I have to provide ID docs? nothing in the PoFA says that's necessary. Would I not discharge my liability by providing the said details?
You don't have to provide the driver's ID. I was just thinking of a method whereby you could provide driver details AND proof of overseas address at the same time.
I don't believe simply providing the driver's name and address satisfies the PoFA with regard to transferring liability. The PoFA specifically uses the word known.
The problem will be if he does not respond to the scammers or denies being the driver.
At that point my interpretation of the PoFA is that the identity of the driver is not therefore known, and liability remains with the keeper.I married my cousin. I had to...I don't have a sister.

Well he is happy to receive correspondence and accept liability, whether he will pay is a different question>>0
-
Hopefully he won't.
Did you email enforcement@parkingeye.co.uk with this info, and with the PCN number in the subject line to make sure that liability was transferred in time before court action?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

No I have only done this through their portal and requested the SAR and further particulars through the email address. Do need to send all this again via post and email? I have a confirmation from PE stating they have received my appeal.0
-
Of course you must email the enforcement term, it's they who sent the LBC!
You can't use a data concerns portal for such things as transferring liability, and it's not an appeal.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Okay now i am lost...
I) Sent a SAR request through their online web form (privacy data) as per advice on the sticky
2) Advised them of putting the matter on hold yesterday until SAR is received via the enforcement email address.
3) Processed an appeal through the ParkingEye portal today and received confirmation - details of driver etc.
Do I need to now do this again via an email?0 -
And that just joins the hundreds of other appeals in the queue from people all over the country at PCN stage, and you are behind all of them this long weekend, and these are handled by the Appeals Team who will not even look at it for 2 weeks.3) Processed an appeal through the ParkingEye portal today and received confirmation - details of driver etc.
The Appeals Team are NOT the people who handle court claims.
Take my advice or don't - this is of course your choice!
I do know how to reply to a P/Eye LBC, I've done it before loads of times and stopped court claims in their tracks by doing things like naming the driver, time after time.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
