Afternoon All,
Letter sent to TPS, No response as of yet.
Apologies fro replying to my Own post, but is anyone able to assist me in drafting an appropriate response message to BW legal, as the clock is low on their 30 day window.
The facts
> Never Received a Parking tickets, They have none on record, They have a Digital Document for an NTC and that is all
>They have no photos or time scale for the alleged offence, No entrance or exit times, nothing.
>There own website site does not recognise the parking offence reference.
BW Legal Letter of Claim has no evidence attached, and no court paperwork, just a letter demanding to know my finances (earning after tax and such)
Could someone assist me with an appropriate response letter please, as each I have posted above have been reviewed and noted as incorrect.
Ive read the requirements of a LBC and this does not meet them, Ive also read that if I do not challenge this before the 30 day window expires then I have no rite to do so later.0 -

How to proceed now? (Please note the admit there never was a PCN???!?!?!)

We are sorry that you feel the information we have delivered in response to your Right of Access request is not comprehensive.
We have complied with our legal obligation under the GDPR by providing you with dada processed by us of you, and we also given you access to our privacy notice regarding your right to be informed. In the spirit of good practice we will provide further clarification,
The Total Parking Solutions Ltd DSAR procedure has created a copy of the case file relating to you as an individual based on the information you have provided to us; In combination with the Privacy Notice that was provided to you, we feel that this constitutes a full and reasonable DSAR response. A copy of the notice affixed on the vehicle is not personal data as it never existed. We hold no copy of the PCN as this was electronically processed and we do not have images of the vehicle.
If we can be of any further assistance, or require further clarifications, please do not hesitate to contact us.

Has there been any threads whereby someone has attended court and lost to TPS / BW Legal despite that they have been unable to provide proof of a PCN being issued?0 -
I can recall one person losing v TPS this year. Can't recall who.A copy of the notice affixed on the vehicle is not personal data as it never existed.
Report them to the ICO. If there was a windscreen PCN, it existed, and it had personal data because it included your VRN and was the document they relied upon to get the DVLA keeper data from the start.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
