  • Update: was supposed to have the hearing today but was scheduled for 20 mins which the DJ said wasn't enough time and he needed an hour. the solicitor for the other side claimed they didn't know we were consolidating the two cases, and neither of us had received the others paperwork (I had posted and emailed it) so the DJ said he will write to us with a final hearing date. I did ask if this hearing could be on papers only as my father and I had to take time off work, and the DJ said it is possible but if there was a debate over a factual detail it would be better if we were there in person, which is fair enough. just annoying!
    Hopefully the hearing is soon so we can put this behind us!

    I think that comment by the Judge should be taken as a very strong hint that it really would be best if the Defendant were to attend a hearing.

    Heed that advice.

    Only if they are. If a case is determined on the papers, you take a risk, but everyone is in theory in the same position.

    PACE v Lengyel was won by the Defendant on the papers. That said, the DJ in my case pretty much said I'd persuaded him at the hearing - so you makes your choice...
  • Update: I called yesterday to check whether VCS had paid the court fees - and they hadn't - so the case has now been struck out. I did ask about costs but the receptionist said to email in about it as she can't offer legal advice ? Not too bothered about the costs, I'm just glad this is over now although it is annoying I spent so long on the defence/WS etc and it probably didn't even get looked at! Does this mean it's over for good?

    The PPC has the opportunity to ask for the court case to be reinstated, but it will cost them significantly more than the £25 fee they just balked at paying and they’ll need to jump through yet more hoops.

    Wait to get written confirmation from the court that it has been struck.

    While you’re no doubt relieved this appears to be over for you, there’s a much bigger picture being played out, so please do one final thing in regard to the big picture - write to your MP (they’ll now be desperate for your vote on 12/12, so no better time to strike) telling him about the debacle and the misery, stress and anxiety this intimidation has caused you and your family.

    Ask him/her, in view of you deciding for whom to vote in a few weeks time, that should they be returned to Parliament, precisely what they intend to do regarding this national scandal, ripping off over 7 million drivers who use private car parks, every year.
