bambooparking - just to check, you do know the evidence is not submitted until WS & evidence stage I hope? You can certainly put two witnesses down (YOU plus neighbour).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Excel v Miss Bradsell C1DP6Q75 Oldham. 27/2/17The concept behind De Minimis is that "the law does not concern itself with trifles." So if the letter of a contract is broken, but the spirit is not and no harm has been done, then no damages for breach contract apply.
This case involved a car parking across a line as a result of other cars parking across the line and had resulted in a knock on effect. Excel had claimed that the defendant had taken up another space thus disadvantaging another driver. In this case it does not appear that any other drivers were disadvantaged as all the cars had parked in a similar way.
You would need to read the blog but it seems to me as if this case could be persuasive on your case especially as you have a WS from your neighbour to say that they were not using their space, Who have you disadvantaged?
I am no expert on this but its a thought.

Can i just confirm, do you mean to say I should get a letter from the neighbour who is a tenant by the way and not the landowner of the bay which i parked in that pre-dates the ticket saying they give authority for me to park in the bay because they dont use the bay?0
