Housing benefit overpayment

    They do yes but as has been advised multiple times, it's the claimants responsibility to contact everyone when a change of circumstances happens.



    This is all i'm going to say on the matter, i'm out of here.

    When you applied for ESA, they didn't apply to council for Housing Benefit for you. You applied to the DWP for ESA and then you applied to your council for benefits from them too

    It's the same when you can no longer have these benefits; you tell the DWP and you tell the council too.

    I thought that I the past when you claimed ESA the DWP would effectively start an HB and CTR claim on behalf of a claimant by automatically referring through to local authority.


    However this doesn't change the legal position that OP is required to notify change of circumstances to separate agencies individually. DWP have acknowledged it was their error and will therefore not seek to recover the overpayment. Local authority were not informed and therefore have not made an error, they are therefore entitled to recover. However, as I said at post #4, I do understand why OP might not have realised this.
    Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.

    Referring though maybe, but its the claimant who is applying for those extra benefits and who signs the declaration for HB and CTR.
