Carphone Warehouse

Hello, My daughter received a phone call from car phone warehouse a day before her contract finished and offered her a upgrade if she took out a new contract early. When I found out that she had taken the contract I was not happy and tried to stop it going ahead under the 14 day cooling off period. When I rang them to cancel the contract this they said she had wavered her rights to the cooling off period verbally over the phone so she cannot cancel. I would of thought that she would have some rights to cancel even under the distance selling regulations. Has anyone had dealing with anything like this?

    If CPW set up a contract for someone under 18 it isn’t enforceable, if your daughter is over 18 why are you meddling in her affairs?

  • Thanks for the prompt reply. Please understand I wasn't meddling. Once she had time to think over the costs of the new contract she changed her mind and asked me for support in the matter...So have you had dealings in something similar???

    If it's an upgrade then there is no cooling off period.

    If they've opened a new contract then you're covered with the distance selling reg. CPW can't over ride the law even if they think they can.

    Upgrades don’t have a cooling off period.

    I think this wasn't clear under former DSR and is even less clear under the new CRA. That's why CPW say about the alleged "wavered her rights", not about upgrading.
