Sorry only bumped this again to thank Fermi for his pm I tried to reply but couldn't and didnt want his/her kindness going without thanks!
So thank you and others have suggested too that I try the consumer board and I posted there today - not sent any letters yet so fingers crossed I find the right thing to say!

Anyway - here it is.
Rayday, can you tell us when the letters were sent so we can see if they have yet made a CRIMINAL offence?

Section 78 http://www.statutelaw.gov.uk/content.aspx?LegType=All+Primary&PageNumber=53&NavFrom=2&parentActiveTextDocId=436428&ActiveTextDocId=436525&filesize=5756 parts 1 & 6 seem to be key here. You have paid your £1 as required but they are still trying to enforce the agreement.
If the timeline is appropriate, i would suggest contacting the OFT. IJ & Irwin both seem to be in breach of the act for trying to enforce the alleged agreement.
Letter from Intrum saying not going to hear from them again being returned to Great Universal (originally it was abound but think companies have merged) was dated 14 November
Solicitor letter was dated 22 or 21 November giving me 7 days to pay Intrum and contact Intrum no solicitor contact details on there at all!0 -

There is a huge DMP Support Group thread with loads of experience of payplan, CCCS or going it alone, really friendly and able to answer all the questions that pop up and boost confidence - give them a visit!0 -
Hi rayday - i actually meant when was the letter you sent to IJ requesting the CCA.
After 12 working days - the creditor is in default
(This means the debt is unenforcable without a court order while the default continues. If you are making payments, you can stop.)
After a further calender month (30 days) - they have committed an offence.
(But won't go to jail)

The date that was the 12 working days plus the 30 days was off the top of my head 8 November its basically been rolling on since September.
