    No such thing as an imminent or pending ccj!

    You get a ccj if you lose at a hearing. It is effective immediately

    You get a CCJ by default if you ignore a claim and the claimant requests judgement against you

    If that request is granted then you have a ccj registered against you immediately.

    Though you won't know about it till you get postal notification
  • I only mean imminent/pending from an 'internal' Court point of view, the only thing that really matters is not trashing your credit file with any CCJ and that can be avoided if its paid off within 1 month of issue, you pay and its like you never had one, fact, and its not effective immediately 1 month period granted to pay off, also Claimant can only enforce after 1 month when it becomes 'judgement in default'

    You are mistaken!

    As we often see here, ccjs go on the register immediately.

    Judgement was made against the defendant!

    It is expunged if you pay within the month, but you nevertheless do have a ccj on record till that payment has cleared and the claimant informs the court!

    In practice that means your "free"; credit report may indeed not show the ccj
    immediately and equally may not remove it immediately it has been paid in full within the month

    But the official registry shows the ccj the day after judgement and only removed it the day after the court has been informed by the claimant they have been paid in full
  • But if there's no credit file damage by CCJ being on the 'official registry' (no idea what that is) then what does it matter!

    Court records are kept by registry trust. That's where the CRAs get their info from

    The CRAs do update within a month but not necessarily immediately!

    Caspar13, whilst I agree with the point Quentin is making, in my considered opinion, for all practical purposes you can ignore all but the first twelve posts in this thread.
  • Interesting thread about CCJ timing. I'm assuming from the comments that the CRAs only grab CCJs that have not been satisfied within the prescribed period. If this were not the case, and they harvested CCJ data relating to cases within a month of judgement, it would be possible for some hapless punters to have a CCJ held against them by the agencies even if they paid in full within a month of judgement.

    The truth of the matter seems to be that there is very little chance of losing with a well thought out defence. I have had 4 parking invoices over the last 5 years which with the help of this forum have all been defended successfully. One was dropped within a week of the Court date as the PPC obviously knew they had a weak case and it was a waste of their time pursuing. All tickets I have recieved were morally, ethically and legally incorrect otherwise I would always pay.

    I am too in a role where a CCJ would be an issue (Material Risk Taker under the Senior Managers Certification Regime in Banking).
    However if I was to explain that I was defending my rights and in the very remote chance I lost, I cleared any judgement immediately I do not imagine it would be viewed negatively. However I haven't tested this theory!

    Correct - and NO RISK to your credit rating even if you did lose, then pay. Scam over.

    So I sent off the the SAR Via email on the 28th and still haven’t heard anything back. I don’t know what information they hold on the driver as haven’t received any of their previous correspondence. I have to submit the defense on or before the 8th and am unsure what to do as They haven’t responded. Any advice would be greatly appreciated
