Motor insurance - car hire question

  • Well she now has her car and her deposit back from Enterprise. They will be invoicing Swift for the car hire and it all hangs on whether they will pay for the extra days. If they do all well and good, if not, she will take it further.

    she is only entitled for the hire vehicle until hers is repaired

    I disagree with you Mr Bear.
    If you have an accident you are legally entitled to be put back in the same financial posistion as if you had not had the accident.
    You also have a responsibilitty to "mitigate losses".

    What "mitigating losses" means is that if the cost of the hire car is less than the loss of earnings that she would incurr by taking time off work and driving from a different town then she is obliged to go for the cheaper option.

    What you are entitled to in law is not the same as what you are entitled to from an insurance package, so don't get the two confused.
