Super result, super report, thank you so much for the feedback.
Funny thing was is that Mr Mc advised that his had ran out 25 minutes ago so would probably have got a ticket.... Irony!
As you say, oh what irony!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Ha ha.. especially if it was a VCS/Excel infested car park as there are quite a few around the area of the court buildings

Well done, great report and TWO good results - you won and the McSolicitorFace might have got a PCN or NOT a PCN depending upon where he parked.
  • Very well done. Brilliant report which will help others fighting claims including these historic VCS claims.

They are not having much success with the historic claims that have been fought on this forum.

Anyway without this rambling on too much, so spent around 20 mins on my point about VCS misquoting and tried to mislead her with the Vine v Waltham FOrest case, and was quite short with Mr Mc regarding this. She even asked him for a copy of it so she could read what I had put on the actually judgement (I had actually put a copy of it in my witness pack. Her arguement was over that they had stated it had set a precendent when actually it was nothing to do with Contracts was to do with Trespass. This conversation between them seemed to go on for ages!
Maybe something to be included in future defences when it comes to "no parking/stopping" cases.
  • Witness statements from VCS and Excel often cite the Vine Case and take it totally out of context. Miss Vine actually won her case on appeal. It's as if they only included selective parts of the case from the initial hearing and ignore the appeal. I guess the representatives are only supplied with the 'selective' parts of the case.

It's amusing that VCS's and Excel's representatives make a point of disassociating themselves from the company (mine did too). Wonder if the representative gets a 'this is not a parking charge notice' on his car that he will challenge it through the courts. Could always come on here for some advice on the Vine Case!

    Hi All,

Just a quick question. VCS are supposed to pay me my costs by 27/11 (Tomorrow) and I am yet to receive anything from them. Can anyone advise what process I can and should follow if it doesn't arrive tomorrow?

    Thanks

You are now asking a question that has nothing to do with parking.

Perhaps LegalBeagles would be a more appropriate place.

MSE's Small Claims Court article also offers guidance on that.
