LOC Received- Being chased for PCN 4 years later, details are wrong

UPDATE: I am in the middle of writing up a SAR request to PremierPark via email and will also email BW Legal requesting them to put it on hold, which I know they will deny. I just wanted to double check however, as the 30 days will keep rolling, and Premier Park may not send me the details within 30 days (as I have read on here some people have had this happen).. what do I write to BW Legal? As advice here as mentioned do not ignore LOC but do I say I will contest this and see you in court... or does a SAR request basically tell them that I will contest in court.. just would like to double check before I send across... thank you.


Hi everyone,

After first receiving my PCN back in 2015 I had read up a lot on my rights, read up on the Beavis case etc and tailored all my letters and appeals based on advice written online. It eventually went to debt collectors, then solicitors who I last heard from in 2016. I offered payments to them in monthly cheques but they were returned to me, and Ive heard nothing since until now, from a different solicitors. Except in their letter they have put in wrong information.... would this help me finally resolve the matter like it would in an initial PCN ticket? How should I go about this?

Thanks for any help you may be able to give, as opposed to back in 2015 I have had no time to read up on everything again, and not sure if this letter is a letter before claim or not as I have seen a thread about it but just too much info to take in right now!

    On another thread you tell us the letter gives you fourteen days to pay. That is a debt collectors letter and can be ignored.

    A Letter of Claim will give you thirty days to pay and should not be ignored.

    Yes, quite likely.

    The only way to stop that happening is to pay them what they are asking.

    No-one here will suggest that solution.

    Seeing as they have written that I did not appeal within 28 days and didnt make any payment (I sent cheques which they then returned to me), the letter is defective and I can just squash this (I say naively?)

    Nope, that is naive and wrong.

    They use template letters, that's all. They are often wrong about people appealing and it means nothing at all regarding defending & winning your case in court.

    Let me guess:

    (a) Is it Premier Park?

    second choice:

    (b) Is it Britannia?

    Tell us what sort of car park and what have you done to get it cancelled by complaining to any retailer on site (yes, even now, this month, of course!).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Hi Coupon Mad thanks for your reply.
    It is indeed premier park, at Torquay marina, which I have seen a few threads about they seem to be a common occurrence. I have been very busy to read them in depth unlike 3 years ago so apologies if I seem to be asking the same questions as everyone else.
    I appealed on the grounds of the discrimination act because of my circumstances of not being able to leave the car park on time, it was rejected by both PP and POPLA. Ignored ZZPS but communicated with Wright Hassall. I sent them dated cheques (cant remember if its was to W.H or P.P) so I offered them a reasonable way of paying but they sent the cheques back. Hadn't heard anything since until now. The last day is today to contact BW and I have ignored it as advised, however whether I have the time to construct a decent defence if it does go to court is another matter... I will try my best!

    We were having a meal with family at Harvester but we haven't complained, is this something we can do even now?

    Yes of course. Go as high as possible up the food chain, brewery manger/CEO for example.

    If you have received a LBC then you should not be ignoring it.

    Do you mean the Equality Act?

    If you want to play hardball, and if this does get to court, you can counter-claim for disability discrimination.

    In any case, get yout MP on side, thay are very familiar with these scams and on On 15th March 2019 a Bill was enacted to curb the excesses of these private parking companies. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.

    Until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. .
    You never know how far you can go until you go too far.
