“No Stopping” PCN

Good evening,
I would be grateful for any advise, as I haven’t gone across this before. I have been issues with an NTK from Parking Control Solutions, for stopping on a private road. The road in question if off a main road, with clearly marked junction lines and for all intents and purposes looks exactly like a standard road. It’s also clearly shown on the Satnav. Pretty annoying as I genuinely believed I was on the highway. My first question would be is this type of PCN legitimate.
I have copied and sent the letter in the newbies section, and they have rejected the appeal. In the paragraph with reference to applying to POPLA they have a section for verification code, but nothing is there, is that required?
Lastly I believe I read that a PCN that doesn’t have a windscreen notification(this was by MNPR) must be sent within 14 days, can anyone confirm this.

    it may well be legitimate, as its an invoice (it is what it is)

    if they are BPA members then they should issue a popla code with the rejection (unless they were phishing fopr drivers details ? - ie:- delaying tactics)

    NO, that is not true at all

    if they fail to send the PCN to arrive in the post by day 14 , it means they failed a law called POFA , meaning that there would be no keeper liability

    there is nothing to say that they cannot send it later , but if they failed to follow the law called POFA, then they are at a disadvantage as they do not know who the driver was and it would be harder for them to make a keeper liable

    POFA is not mandatory

    ps:- edit your post as the following words should not be used

    "MY , ME , MYSELF & I"

    what happened on the day happened to the DRIVER

    what happened SINCE THAT DAY happened to the KEEPER

    those are the only 2 words to be used
  • Thank you for the swift reply. I’ve actually just found another thread, that is identical to mine.
    PCN wasn’t sent within 14 days
    No POPLA code.
    I’ll follow the advise in the other thread with reference to complaining to BPA & DVLA

    I've always wondered how a Parking Charge Notice could be issued for a No Stopping contravention ... stopping isn't parking. :)

    Wait until after 35 days just in case they send a PoPLA code. If you haven't received one by about day 40, then make your complaints to the BPA and DVLA.
    You should also complain to your MP about this unregulated scam.

    The NEWBIES has a ink to the PoFA. It takes a bit of reading, as does the NEWBIES itself, but it will explain the 14 day requirement to transfer liability to the keeper. Make sure you do not reveal the driver's identity, not even on here.

    Especially when POFA only applies to "the parking of the vehicle on relevant land".

    Quick question as I prepare my POPLA appeal. The images supplied with the NTK clearly show the driver is male, whereas the registered keeper is female. I’ve looked through other responses but can’t find if this is a relevance to the appeal. Any advice on that would be appreciated.

    It's obviously worth stating as part of a point about no keeper liability if they have failed to comply with the POFA (wording & date of NTK).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    They are obviously trying to scam you so complain to your MP.

    Parliament is well aware of the MO of these private parking companies and on 15th March 2019 a Bill was enacted to curb the excesses of these private parking companies. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.

    Until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.
