Confused about a CCJ

Hi everyone (not my real name on username)

I have received a CCJ according to clearscore, just found out yesterday my file will be updated with it. It’s from a parking ticket.

I received the claim form and filled out the section asking to pay in instalments. Hey assumed this was an option to stop it actually going through the courts - if I hear back from the agents agreeing to the debt repayment terms then I have settled the matter outside court and therefore won’t get a CCJ....right? Well I must have been wrong?

I haven’t received anything from them since I sent off the claim form just over a month ago. I can pay it in full if it means I can clear the CCJ off my file but I guess now it is too late? Why wasn’t it clearer that paying in instalments still meant I got the CCJ, and why didn’t I hear back from the solicitors office I sent the form to informing me they have not accepted my offer...I could have paid in full there and then. It’s incredibly frustrating because I have a great score and all that’s aboit to come crashing down and it looks like I won’t be able to buy a house for 6 years now.

Is there anything I can do here?

    The forms are from the court.

    If you clear it within a month of it being applied, it will be removed.

    Either way, you can still buy a house within 6 years.

    Thanks for the reply, I wish I had kept a copy of the form because I thought it had on them the date of the hearing, after all I did not receive any other correspondence, I assumed this was my final chance to pay before the hearing which I could have attended. Is this wrong?

    Would the next steps for that to be calling the solicitors who took me to court and quoting the case reference or the court itself? I have read conflicting info and am left pretty confused.

    It’s the terrible mortgage rates I really want to avoid, I had a great credit score and it’s very low now because of £280 :(

    Don't worry about the score. No one's looking at that. You need to manage your credit file to appear low risk.

    Get the debt paid in full before the CCJ is granted or within 30 days and it won't show on your files going forward.

    Ok thanks, I can definitely do that, how will I know when it is granted because if it has just appeared in my credit file that looks granted to me?

    That looks pretty granted to me too.

    If someone feels compelled to take matters to court to resolve a dispute, then you will receive that claim form from the court. It will include the costs of the claim.

    You have 3 options:
    1. Admit the claim
    2. Admit the claim in part
    3. Defend the claim

    If you do (1), then a CCJ will be issued which you need to pay

    Otherwise it goes to court usuallly for hearing, where the costs of the hearing will be added to the claim too. Then a CCJ will be issued, which will include the amount admitted (if any) and any amount the court decides you owe.

    If you need to pay anything, it's not for you to decide to pay in installments, but if you cannot afford to pay what is owed you can complete form N9a and a decision will be made if you are permitted to pay by installments (or in full but deferred)

    Irrespective of the above, unless you pay off what is specified you owe on a CCJ in full within 30 days of receiving the judgment, it will be entered on your credit record at the Register of Judgments, Orders and Fines. It'll remain there for six years.

    If you could afford to pay in full, why didn't you? If you had done this before the matter even went to court, you could have saved the court fees too. :cool:
