    Hi guys,

Is it still worth asking for a SAR at this point, as someone says in the forum, no one bother about SAR esply when I have just a week to provide a defense. Also there is a slight discrepancy in the address, could I use this in my defense although the claim form also has the same discrepancy to my actual address.
I wrote this on another thread earlier this afternoon:
Send a SAR anyway. The information returned is likely to be of more use at Witness Statement time which is some weeks/months away.
Check your address on your V5c. The PPC got your address from the DVLA.

just to be clear, if your address is incorrect on your V5C, then its your fault for not checking it, in which case you cannot blame the PPC or the CCBC for getting it wrong , hence why you need to check the V5C urgently

I am reading more threads as possible Coupon Mad, but still struggling to draft my defence as I feel the only one defence is the unfair part of the PPC charging me, but then by parking in a place where they have clear signage to say that it would cost 60 as penalty and liable to go to 100, is the driver not entering into that contract? This is where I find it difficult on what basis I plan my defence. Please advise , sorry if I am being dumb, u must be having plenty who ask the same questions.

As for your query Redx, I dont have the V5c for the car anymore as I have sold it, but the discrepancy is just one word on the address, but as I do get posts with either of those words I am not going to pursue that in my defence, thank you for your advise

Completely wrong, in fact that point - about the high 'price' is not a defence.
but then by parking in a place where they have clear signage to say that it would cost 60 as penalty and liable to go to 100, is the driver not entering into that contract?
That is what they will argue.

Show me ONE SINGLE thread where a person here has not parked where there are signs up? Every single person is in exactly the same situation as you are and parked where there were signs about the £100, or whatever.

The signs can't have been that clear and I bet you the £100 was NOT on the PDT machine screen, nor listed in bold type on the tariff list? We know it wasn't, it was hidden.

Even if you lose the defended case you save money, as they've added unrecoverable crap.

So the driver stayed for an extra hour - what sort of car park, a station?

thank you Coupon Mad for getting back, I do agree that in almost all the cases on the threads the signs were not visible or they were hidden, In my case it is a station car park but unfortunately they have signs in bold all over the place with the penalty charges, the PDT machine doesnt say about the penalty charge, but right next to the machine they did have signage to say about the penalty charges. I can post the pics if you want me to. The way I am looking at it is if they showed the pictures then I wouldnt have a leg to stand on. I might be wrong here and that is the reason why I am seeking your guidance. sorry for the late reply, I am struggling to come up with a defence, but having going through some of the threads I will post a draft here 2morow after work to see what you guys think.

Many thanks to all of you for your input and advise, you guys are doing a great job taking the time and effort to help people like me.

No keeper liability, then, as this is not 'relevant land' as you will have seen by reading any other station car park thread.

How have you missed the POFA and the fact it doesn't apply on railway car park land?
I can post the pics if you want me to.
Yes please, but hosted in Dropbox, and as you're new you will have to BREAK THE URL SHARE LINK. Newbies do this all the time. Just change http to hxxp or be imaginative.

Don't reply telling us you 'can't post a link' as you are getting a board message... :)

    Yes, that link works, but...

Let me guess... your initials are xx and your first name has nn letters?

If that's right, you would be wise to delete that dropbox link in your most recent post and sign up again to Dropbox using a totally anonymous username.
