Euro Car Parks Capital Quay

Hello,
I have this morning received a letter as the registered keeper of my vehicle saying that on a certain date my vehicle was parked without a valid pay by phone transaction. This was issued By euro car parks for the car park at Capital Quays,Manchester. After some research I've discovered that for less than 2 hours parking it is only 10p and this PCN is for £100 (or £60 if paid within 14 days). Is this legal?
I have taken advice from the newbies page and have complained to the restaurant that I was visiting and plan to appeal directly to the firm. I was just after any tips to beef up my appeal?

    Unfortunately, yes it is lawful.

    Send the appeal template in blue from the NEWBIES unaltered, from the keeper.

    Get pics of the site and signage for use later at PoPLA. Compare the NTK with the strict requirements of the PoFA to see if they can transfer liability to the keeper.

    Complain to your MP about this unregulated scam.

    That's the main way to get it cancelled, or escalate it to the RETAIL PARK MANAGEMENT.

    You can't beef up the appeal, you just use the NEWBIES thread one.

    You will probably lose at POPLA, but try anyway. ECP can be ignored as they never try court, please no posts here in the future about debt collector letters after losing at POPLA (we really never need to see any ever again, just a heads up).

    The NEWBIES thread post #3 covers the template words to try at POPLA.

    That sticky thread post #4 shows why we never need any posts about debt letters.

    Can you tell me if you were successful in your appeal? I got one from the same car park today and cannot understand how signs were missed if they are so clear?

    You don't need advice from someone with a PCN from the same car park. Who cares if they won or lost at POPLA, given the advice we gave, it doesn't matter.

    You already saw what the advice is about any Euro Car Parks PCN:

  • Yes trust me I've looked at ALOT of advice over the last few hours since getting home from work to it and have done everything suggested however with it been the same carpark (which would suggest to me the signs arent good enough) and not long ago it would just be nice to hear a success story that's all!

    The signs are never good enough. They put them stupidly high.

    But POPLA cases are not normally won on that basis unless it was dark (but who cares, it's only ECP - I've cheerfully ignored them myself!).

  • Have you ignored them from the offset though and not appealed it? I feel like appealing it has not helped! I have genuinely scrolled through pages and pages trying to find info on the best thing to do I just dont want to end up paying £100 or over if it's going to come to it in the end I would rather pay the reduced £60. Sorry for rambling I'm just so frustrated about it!

    a landowner complaint and cancellation is ALWAYS the best solution

    anything else has no guarantee of success

    if you are appealing it, appeal as KEEPER with the blue text template from the NEWBIES FAQ sticky thread

    stop looking for an easy get out , winning or getting this quashed requires some work including research and no blabbing about who was driving or what happened on the day

    Yes, but that was pre-2012 (before POFA and POPLA existed).

    Now, I would always try appeal to a BPA member because some cases are won at POPLA, particularly with photo evidence of lack of signs, or unlit signs if it was dark.

    But no-one pays anything to ECP even if they lose at POPLA; that's what you are missing in all this, it doesn't matter.

    And the main weapon is ALWAYS landowner/retailer complaint, first.

    Certainly BEFORE POPLA, as it has a nailed on successful result if you do it early and can get a Manager to agree to cancel it. Not so simple after POPLA.

  • I appreciate what you're saying BUT some people have been taking to court and had to pay quadruple the amount. It would just be my luck to be one of the unlucky ones! Thank you for your advice though
