Driver 99% in the wrong.
Too close if he's anywhere near hitting you.
If he's trying to overtake where there isn't space (something oncoming?) then that explains why he's too close, but doesn't excuse it - should've been more patient.
If he's noticed the hand sign then he should know you're stopping - even if he doesn't know it (he should) then he should still be expecting you to do something and give suitable room.
We're you signalling before he pulled alongside (and into) you?
The only fault that could possibly be laid on you is driving in the gutters and leaving enough space that an idiot would try to squeeze through it (the reason not it is clearly evident now, so let's not say it)...
Either way, unless you've done something unpredictable (signalled so n/a) it's not really you, you've just opened the door to the possibility of someone doing it.0 -
I stated in my first post , no indicators , no brake light , even no speedo , also restricted to below 30 mph , and can (by many people) be ridden on a full car licence without L plates
unto changes in laws in mid 90s they were in fact listed as moped on v50 -

riding ALMOST in the gutter , and I gave hand signals , much longer than the average bus use there indicators to pull out , the guy was behind me when I was giving hand signals well before actually stopping
single lane on my side , 2 lanes going to junction opposite , with standing traffic waiting to turn right0 -
Riding in the gutter gave him room to try and squeeze through.
Being in a more sensible position would have denied him the opportunity.

mentioned over and over again , I was not on a cycle , I have to abide by laws of the land unlike many cyclist I see on pavements , with headsets on and on there phones0 -
You're cycle width. You're (a bit) faster than cycle speed.
You have even less reason to sit in the gutter than a cyclist.0 -

That's not what either of us are suggesting you do
You didn't claim the carriageway - by leaving enough space for a car to pass, you encourage people to try it... Even if they shouldn't, there's always some that will see your road positioning as an invitation.
When it comes to any situation like this you can only consider yourself 100% blameless if you've done everything possible to prevent it - and in this case, that's making it clear by your road positioning.
That said, the driver still shouldn't have gone for it - it's just that, for future reference, you're less likely to have drivers for it if you ride confidently and claim the road.0 -

I was waving my arm to signal , before and AS he past , continuously
I was NOT committing criminal damage giving a hand signal , he was the one that nearly knocked me off and attempted to break my wrist0 -
It seems odd that a hand signal should have sufficient force behind it to detach a mirror...
Still - if you were signalling all along, it could be argued that he shouldn't have passed such that it'd be within reach.0
