    To what extent would POPLA think that ‘Elite Management Midlands Ltd’ lack of BPA membership was grounds to cancel this Parking Charge Notice?

    They probably won't but it is possible (unless they have an agreement that cases are still considered for a short time after they left the BPA) that POPLA is not available to this firm any more. Who knows? They may have lied about that!

    Hence report this possibility and the use of the BPA logo to Steve Clark and ask him to CONFIRM what we've told you, so you are not asking the landowner to believe just us!

    PoPLA only deal with second level appeals against BPA members, although as C-m says, it might be possible.

    I’m really interested to know why you say that POPLA won’t be dealing with this?
    Obviously because Elite are banned (who knows if it's permanent) from the BPA AOS.

    When firms have been kicked out before, they were not allowed to use POPLA.

    Hi all

    I received a very swift and helpful response from BPA confirming that
    Elite Management Midlands are part of this authority although have had their membership benefits suspended which includes access to DVLA.

    I am currently going down the landowner route and failing that will go POPLA. Any advice on how this may be done
    Would be gratefully received.

    Interestingly, I took photos of their signs today and none are specific about actually needing to display permits. ‘Permit Holders Only,’ but no mention of having to actually clearly display these, which is (I presume) the reason for me being ‘unauthorised’ to park. I am, after all,
    a permit holder.

    Perhaps it’s time to do the right thing and open a new thread of your own (forum requirements and etiquette) as this is not your case here.

    You’ll get all the help you need on your own thread. Responding to two different cases on one thread is likely to end in confusion and risks someone making mistakes.

    Email the BPA back and ask whether Elite are allowed to offer POPLA whilst they are suspended, because you need to know where you stand, having pointlessly handed over your data to a firm who could never have got it.
