I totally agree with your attitude towards people taking parking places of the medical centres for their own use. And I am sorry that I mislead you with my “conspiracy play”.
The event DID happen during the weekend when the practice was closed, when there were no sick people around, there were plenty of free parking spaces. No harm done.

What do the signs say with regard to parking there at weekends?

Doe it say that parking is only allowed during Clinic opening hours or for patients attending the surgery?

If so, then the GOOD thing is, it makes no offer of a parking licence to anyone at weekends. The issue could only be a matter of trespass, which is not something a parking firm who are not in possession of the land/a lease, can twist into a contractually agreed offer.

    Show us the signs.

Even though some posters have little sympathy, the fact remains NO-ONE here is telling you to pay! Hope you get that.

Clearly that is a forbidding sign.

It does not offer parking to people in your situation, therefore the issue is one of trespass.

Only the landholder can pursue a trespass case.

    CMS have no case.

Good news, I guess... Does the sequence of my actions change with the respect to this info?
Do I still appeal to CMS?

Follow the NEWBIES FAQ sticky, post #1 advice on dealing with this.

You should do so in the knowledge that this is an IPC Operator from which you might never get closure until 6 years have expired or a Judge is asked (by the PPC) to determine the validity of the charge, whichever the earlier.

Alternatively you press the landowner to help in getting this cancelled, but I wouldn’t be asking them to help with a position of:
there were plenty of free parking spaces. No harm done.
I would be somewhat more penitent!

The £100 is in the smallest font. Compare it to the Beavis case sign (Google images).

    No harm done.

Trespass? Acting in a manner contrary to the landowners wishes. Is it any wonder that these scamming companies thrive.

The same operator supplied false evidence to the IAS, which was accepted by them.

    Alleged contravention: Jan 2019
Evidence supplied to IAS: 08 March 2019
My last photo evidence: 12 March 2019
Signs changed by operator: 20 March 2019

My evidence was of signs depicted on the actual site.. The evidence the operator supplied evidence of an 'Image of a sign' and a sign in a van.. None of which were displayed at the time of my appeal or time of the alleged contravention.

The IAS are a joke.. so are the IPC.. I am curranty seeking to bring a complaint against them both. It would be great to find out who the 'Adjudicator' was.. as the IAS and IPC cannot go against their decision or even look at it... mmmm

Good luck with your case, I will be following this thread
