    The judge said she believes the grace period starts at the time at when you're parked. Not when you first enter, and that the 10 minute grace period is a minimum as everyone is different. She said something briefly about abuse of process and had mentioned something like sar or sra?? tbh I can't really remember what she had said specifically as my adrenaline was pumping.
    sar=Subject Access Request
    sra=Solicitors Regulation Authority

    So I'm guessing it was sra as it refers to abuse of process by a solicitor.

    Nice report and nice win!
  • I guess so, I really have no idea lol
    Thanks Le_Kirk.
    I felt the judge was encouraging me to add more to costs, but had no idea what else to say lol

    Yay! Your case will now show up when newbies search for the keywords:

    another one bites the dust Gladstones

    Well done to you, and what an amusing account:
    I had to enter a full scale Judge Rinder type court room, but was empty. With just me, The judge and the usher in I !!!! myself ( not literally).

    On first glance the judge looked annoyed., almost angry as I entered. As I sat down she said 'what a surprise, HX and gladstones not to show yet again'. She then asked me about my day in Southend, 'did you have a nice day? ', 'was it busy?'-' was it hot?' the Judge had said it with humour in her voice- I replied yes madam.

    ...At this point she was smiling at me and tbh I didn't know !!!!!! was going on lol. A further more £20 for printing postage. Then she asked if there was anything more I would like to claim... At this point as you could imagine my mouth was pretty much on the floor.
    I can assure you she was reaaaaaallyyy annoyed at them. The judge said she had 100s of these type of cases every month from them. She then went to compliment my defence and witness statement asking if I done it myself. Which I replied I had a lot of help from an online forum. The judge then chuckled and said " Ah, yes. It's nice there's some good people out there". And I agreed.

  • Congratulations. Well done.

    Isn't the RCJ an amazing building (albeit not the newer Thomas More Building added on behind it, where your hearing might've been)?

    Everyone gets lost there a few times!

    Sounds like you were "pushing against an open door" as they say in the trade. Had you presented a bigger bill for costs you'd have probably got it.

    The courts would soon stop this nonsense if they demanded personal attendance by a company officer or lawyer to explain their non-attendance at court. It is a discourtesy and a massive waste of costs.

    @Johnersh - out of interest, could that be orchestrated on a national basis, and who/what organisation would conduct its rollout? Or is every court all but independent and not bound (other than by the law) by any central direction on procedures?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • It'd need to be put in the CPR really to guarantee uniform approach.

    If the court simply strikes out a claim, then there is no live proceeding to ask the claimant to attend in connection with.

    Whilst I'm hypothesising: it seems to be policy that the PPCs hedge "we may not attend." I'm guessing that they then try and instruct a single advocate to do multiple hearings for one day's brief fee. Presumably if you get lucky - no similar claims, remote court or a date where there are no suitable advocates, then they just don't show.
