Mortgage PPI - How do I prove my parents were illiterate at the time?

    They came from a village in india and moved here in the mid 1960’s and to date neither of them had any schooling in the UK.

    Whilst they had no schooling in the UK, did 40 years of living here not give them any understanding of English?
    They were not aware of the PPI instrument attached to the agreement nor did they know or understand its significance.

    Mortgages do not have PPI attached to the agreements. It is one of the reasons why most PPI complaints actually fail. MPPI is standalone.
    They were ex-factory workers on a very low income and in need of the money at the time.

    So, MPPI is actually a product that would be suitable for them and have a financial need for it.

    The problem with this sort of complaint is that it is difficult to prove any wrongdoing. For example, you claim they couldnt understand the PPI. yet they could understand the mortgage and life assurance.
    It comes across a bit as selective failure to try and get a complaint to succeed. A lender won't say that but their response suggests they think it. And it is not an unreasonable position for them to take.

    Where a complaint fails to identify a failure in the points raised, the lender has to go on to consider the suitability of the product. In this case, from what you have said, it seems entirely reasonable and sensible for them to have MPPI.

    Remember that we are talking about MPPI here. Not loan and credit card PPI. You can still buy MPPI today. The FOS reject most MPPi complaints. It is considered more valuable as a product type than the others.
    Can you clarify why you believe it hasn't been miss sold if they didn't know it exsited and thus were not aware of it.

    They didnt know it existed but it had a monthly payment. How did they miss the monthly payment?
    Every try-it-on complaint uses the "didnt know I had it" excuse. Very few complaints manage to succeed on that particular point. Its easy to say but hard to prove.
    Having reviewed the additional loan checklist all the required criteria has not been checked. I'm inclined to believe most of the information may have been used from the initial application or system data - that could be a possibility?
