Have a second try at seeing if you can access earlier location history on Google Maps timeline on your phone. My maps timeline history goes back years.
Demonstrating your phone was elsewhere is a pretty pointless exercise as it proves nothing about where the car was.

we are just not in a financial position to risk further charges and potentially loosing at court.

There is an almost zero chance of you having to pay these scammers a penny. Judges are familiar with double dipping claims.

AnPR cameras are known to be innacurate in several cirmstances, bad weather, tailgaiting, pedestrians crossing, dirty number plates, etc., etc., etc., They are banned for revenue collection issues in local authority car parks. Why do you think that that is?l

The PPC and the ATA know this, but they are trying to bully/trick you into paying. Your MP also knows about the scam so complain to him/her.

    They know full wellrdBn

we are simply not in a position to risk facing additional 100s of pounds because of this.
WHAT ON EARTH makes you think a small claim makes it hundreds of pounds?

    Wrong.

This saves me typing, please read it and stop assuming a claim = £££ added!

And you WILL NOT LOSE a double dip scam defended case...

To win this/get it cancelled without too much sweat, you need to do this now (right now, don't ignore it) and there is a SAR template in the NEWBIES thread:
Another thing you should consider is sending VCS an SAR (subject access request) requesting all personal data they hold about you and your vehicle including any and all ANPR camera photos etc. There should be useful examples on this forum that you can use for the SAR. They may trip themselves up and hand you evidence that you didn't stay in that car park for the entire time.
Thank you for this information. Would VCS have to provide this information even if I had pay the £100 fine, and if so would they be obliged to refund me if the SAR evidenced my argument?
Yes they HAVE TO provide all times that your car was captured that day, if that is what you ask for in your SAR that you simply email to VCS' data protection email addy (see their privacy page, yes, they have one).

No-one is going to be paying them (and it's not a fine)

You were SCAMMED by a double dip! Prove it by getting the ANPR captures that day from VCS themselves...DO THAT EMAIL RIGHT NOW.

I repeat - there is a SAR template in the NEWBIES thread.

Add to it a SPECIFIC request for the records from ALL entry/exit cameras that day, showing your VRN and any partial captures of a partial plate (if partly obscured on one entry/exit).

State exactly that in your SAR email. It is not an appeal, don't word it as one.

My posts were more concerning the personal phone location data for an occupant of the car as put to the OP. I don't think I recommended anyone to use location data for a random phone that would not have been in the presence of the car because as you've pointed out, that would be a waste of time.

The Google Maps timeline shows distances over time and also delineates when it can between movement on foot and other transportation modes. The location data could then corroborate the first entry at the time and location mentioned on the PCN and also the last exit, but more importantly the missed entry and exit that VCS's inadequate system failed to record.. All said and done, my original posts made it clear what was being hinted at and the OP understood but unfortunately doesn't seem to have that data available.

Have you any update on this claim. I parked my husbands car there in Autumn 2019. stayed just over an hour ( I believe you can stay for 2 hours free) but did not buy a ticket -as I didnt see a machine. It was dark and wet and I found a space immediately near the entrance, plus I believed it was free.)
We initially appealed -it was rejected
My husband has now received a letter from small claims court.
    Not sure how to proceed
Would love to hear from you and others experiences/ advice.
    many thanks

    @ juli

Presumably it was Autumn 2018 ?

You will find the info you need to defend a claim in post #3 (written by Coupon Mad) in the 'Newbies Thread' the 3rd post down on the opening page of this board.

It would be a good idea to start your own thread for further advice.

Are you aware of POFA 2012 and it's implications?
Did VCS refer to POFA in their PCN and further correspondence, including the claim?

As the claim is against your husband who I presume is the keeper but wasn't the driver at the time of the 'event', VCS will find it tough to successfully claim against him without utilising POFA. That is unless he appealed to VCS as the driver rather than keeper.

Unfortunately Excel/VCS are very aggressive and do pursue all the way to a court claim in the vast majority of cases. So be prepared to face that prospect further down the line by doing plenty of reasearch.
