    No probate on a first death is very common, and HMRC would need to prove that not all of his estate was passed to his wife if they wanted to mount a challenge.

    The only reasons I can think of for not claiming the residence NRB is that if forces you to go down the IHT 400 route rather than using the much simpler IHT 205, 217 procedure, or your solicitor is not up to speed with IHT rules.
