uninsured losses

On 19th November I had a minor bump on the motorway in slow moving traffic ( traffic jam)
I accidentally bumped into the back of the commercial van in front of me. It was my fault an no one was hurt
Just a bit of damage to front of my bumper and the drivers back bumper
Insurance all went through and I did lose some of my no claims
I thought that was the end of it....
Then on 28th December I got a letter from a company called CORCLAIM asking me for my insurance details as their client was perusing me for uninsured losses
I sent the letter to my case handler at quote
me happy and advised CORCLAIM of the claim number and details of my insurer
A few weeks later I got another letter from CORCLAIM advising me of the amount they were seeking and said the claimant would accept an offer for early settlement. It also advised in the letter that a copy had been sent to my insurance company. I thought that would be the end of that and quote me happy would sort it out.
My insurance was up for renewal in Feb 2019 and I was quoted twice the amount I paid before the accident despite losing 6 years of my NCD
I decided to look around for a better quote and eventually changed my insurance company on 1st Feb
I Got a county courty summons’s yesterday 6th April 2019 with date of service 9th April advising me that I was being personally pursued by CCMCC for these uninsured losses totalling £1754.00 and I have 14Days to get legal representation or pay
Why wasn’t this acknowledged by my insurance company who I had Legal Services cover with to sort out
Please help I can’t get hold of quote me happy you can only email them which I have
Any advice would be very much appreciated

use the same method now as you did preciously , your claim is still active and even tho you are with different company now THEY SHOULD ACT ON YOUR BEHALF
if you have received GENUINE letters from CC you need to act fast , you have only 14 days , then a default will be made against you

fill in the form saying you wish to defend , do not do any more , do not enter anything at all apart from defend , to do this you need to log onto the website with the password on the letter , t a lter point you will get a run down on EVERYTHING they are claiming for , and you can get (free) legal help , if you hire solisitor you cannot claim it back
they will have already added the inital court costs , so tthe amount cannot go up untill they pay for the actual heating
U will guarantee that 1/2 of the supposed costs are "fabricated" , and can be challenged0 -
Sorry to be the bearer of bad news, but;
The other party is pursuing you for their uninsured losses, your insurance company doesn't cover that.
Their 'Legal Cover' service would but you in touch with a law
Your insurance company will deal with claims like this from third parties. You are covered for this!!
Don't agree to make any payment at all - that's more bad advice
Do pass this claim form unanswered on to QMH to deal with and check with them they are doing so!0 -
QMH cover will be minimal and it looks like from what the OP said they aren't handling the court claim on the OP's behalf, but hey whatever...
Even if the OP only has third party ft cover it will pay out if the claim is accepted!
"Uninsured losses" don't come into claims from third parties
The liable driver's insurance will pay all the third party's costs!0 -
QMH cover will be minimal and it looks like from what the OP said they aren't handling the court claim on the OP's behalf, but hey whatever...
An uninsured loss relates to the claimants own policy not covering the loss, hence it being an uninsured loss, it doesn't refer to the OP's policy not covering it.0 -
UILs include policy excess, loss of use, hire vehicle, postage and telephone costs etc.
As your insurance company haven't settled it proceedings have been commenced against you.
You get to contact your insurance company at the time, let them know you have received this and post it off to them to deal with; keep a photocopy of it for yourself.
Phone your insurance company a few days later to make sure they have received it and ask them when they are settling it as you do not want a CCJ as a result of this.Mortgage started 2020, aiming to clear 31/12/2029.0 -
a letter before claim should have been sent by CCMCC , if you had got this letter you could have pre warned your insurer
i feel that you have little chance of them intervening before the 14 days (after receiving papers) and you will get a default CCJ against you
this will be heavily loaded with "fake" charges , that your or your insurer could and would challenge0
