Unresolved Claim - Looking for some advice

Hey all, first poster here :j
I'm looking for a bit of advice as I wouldn't class myself as a new driver, but I'm new to the insurance claim side of things as I've managed to stay quite unscathed for a while on the road until recent.
Some back story of me:
23yo, full licence since Sept 2017, will be hitting the 3 years ncb in September 2019 (due to previous 1 years provisionally licence policy also) clean lisence and not a single accident in those years until now.

Some back story to my issue:

Back in Feb 19, I was parked on my street (narrow street, cars always parked everywhere)
I was parked less than 2 meters from the give way line at the end, with a single car behind me.
I reversed slightly then stopped, checked all around me and nothing was there, indicated to pull out of my parking space, as I was 1/2 way out of the space, a car had joined the road from behind, and scraped down the side of my vehicle, he stopped almost 3 car lengths in front when he realised, whereas I stopped immediately.
He got out and audibly (on dash cam footage can be heared) stating "I am sorry, I didn't see you, I was looking for a parking space I didn't see you"

We exchanged info and I was freaking out (naturally as I bought the car new in Sept 18)
I contacted my insurance and told them, didn't want to claim as I could have my car repaired on cosmetic insurance with PSA.
Anyways, some months go by and I find he is claiming to the tune on £1600 for his repairs, he claims this is the amount an independent garage quoted.

I have video of this, I also have a whole heap of images from the scene, including where I was relative to the give way line, the line he should have slowed down for to turn onto the road, images showing how far I was out of my space before the impact ect.

Also worth noting, third party lives across the street, we have spoken but he still wants to proceed with claim for his banged out 2010 Renault (that had a lot of pre existing damage prior to this incident).
I am unsure how this will play out, as I'm not claiming but he is.

I am also unsure on how this may affect me in future renewal, will it more likely be a 50/50 or a 70/30, even though this was easily avoidable on his part if he was looking as he turned the corner? As he would have been invisible to me until I slammed on my breaks when we collided.

Does it favour me if i havent claimed on my own policy? Just someone else has?
And how will me not claiming on his insurance affect him? As i want to ensure if i have a strike against me then do does he (it's only fair really)

    Simple question: Were you still moving out of the space, into the road, at the time of the impact?

    No help to you now, but in the future open your windows when maneuvering. Then you have an extra sense (hearing) to know if anyone is coming along.


    I open windows at T junctions, driveways, parking, etc. Often on roundabouts, you can tell from a person's engine sound if they are thrashing it, so might collide with you.

    Now when completing any maneouver, my windows are down and my head is out the window, no music on, and I stop every few seconds to ensure in 100000% clear of anything.

    You're unlikely to get away scot-free, then. After all, you ARE partially liable. You were manouvering into the path of traffic, which you simply didn't see - because you weren't looking properly.



    Sure, the other guy could have avoided you, too - but if you'd been looking while you emerged into the path of traffic, he'd not have needed to.

    Its situations like this where both insurers take so long to deliberate. You get left in the dark.

    The roadside apology you have on video is irrelevant as far as liability is concerned

    Any split liability will mean you both have a fault claim as a result of this

    You would lose 2 years of your existing NCD and none awarded for the year the claim is made

    All claims do take months to resolve

    You can get an idea now of what difference a fault claim will make to future premiums by doing dummy quotes online with and without the claim and loss of NCD in your history.

    The Highway Code tells you not to park within 10 metres from a junction. If the OP had followed that rule, then maybe the TP would have had time to avoid the collision.
  • If said rule was followed, parking would be restricted to around half way down the entire length of the street, as the street itself is probably not more than 30ish metres long
