Can I sue my neighbour ?

    Frankly living next door to a cafe I'd be both expecting noise and private parties. Many cafes and reataurants hire out rooms or the whole premises for functions and no they've done nothing illegal. In fact they are doing the right thing in trying to get your flat.

    Asking the letting agency to serve notice is reprehensible and morally questionable. What the cafe should be doing is entering in to amicable negotiations with the tenants (i.e. the OP) with an offer to take over the flat along with an offer to assist with relocation expenses.

    What they are doing is legal but immoral.

    You don’t have any recourse in law however you can also play their own game.

    Social media campaign, daily wail campaign, naked civil protest, invite a million people to queue to go into the cafe but buy nothing.

    When running a business it’s good practice to keep your neighbours happy.

    Knew a noisy local that the council didn’t like but neighbours did. Owner was good at good at sharing his booze with local neighbours.

    Would I waste time, no. But I am sure when naked, unshaven, unwashed crowd descend to fart by the cafe, the business is good as a dodo

    OP should carry out that kind of campaign to harass and inconvenience (presumably), honest hard working people? :eek:

    Don't you think their energy might have been bettered served carrying out better due diligence before taking the flat?

    Anyway, as others have said, the authorities are involved as per the OP's wishes and have taken action.

    Not sure of the point of this thread TBH.

    There's no point doing that unless the landlord is interested. And they're not.

    Well, from the cafe owners Point of view the tenants are clearly unhappy living there, they may think they’d be glad to be allowed to leave early. That’s what i’d Think!

    Sorry you’ve had a bad experience with that cafe, One of my neighbours occasionally annoys me with her house music until 3am on a weekday so I can relate a bit. I however am biding my time until I get my system set up and I can crank up the Death Metal :>

    I don’t think you have any grounds to sue them based on them asking your agents to get you out so they can get in. I would be a bit concerned with your lettings agent telling you the cafe people have asked such as that seems to be a breach of confidentiality and it would concern me what they might be saying about me

    I think that if you could sue them or rather take them to court over anything it would be because they were interfering with the peaceful enjoyment of the property you reside in but I think that’s a question for another thread.
    You moved in to a flat next to a pre-existing business and then proceeded to try and get them shut down, I'm not surprised there's bad feeling.
    I don’t think that complaining about noise levels emanating from a caf! passed its normal opening hours constitutes trying to get them shut down

    To be more accurate, the disturbance they were causing one specific neighbour. Which has now stopped.
    And revenge reviews despite any problem no longer existing certainly seems to hit the blackmail spot.

    Thanks to everyone who was understanding of the situation.

    It shocks me to see how many people side with selfish business owners who simply don't care about destroying people's lives to the point of trying to kick them out of their own home just to make some extra money.
