Train fitness cancelled venue and wont give a refund

HI :j
I booked onto a personal trainer course that was part time so majority of the work done at home via computer and 16 weeks of training and assessment days at the local gym (2 miles away) they messaged me last week to say they had cancelled the venue and my nearest one was a full time course (3 weeks) 2 counties away (roughly 70 miles and a 4 hour round trip)
I have since asked for a refund and they are not budging saying it states in there terms and conditions that I ticked to say I had read that they can do that.
Does anyone have any advice on this as they are now offering distance learning as i turned down the full time course and I'm really not comfortable doing the distance which is why i paid for part time.
I am really at a loss what to do

How often do you have to go for the assessment days?
Thrifty Till 50 Then Spend Till the End
You can please some of the people some of the time, all of the people some of the time, some of the people all of the time but you can never please all of the people all of the time

Do you have any home insurance?
Have you checked if you have acces to a free legal helpline?
  • No I haven't looked into that. I have seen a solicitor and they say I'm pretty much stuffed! Not the response I wanted for half an hour at £96!

Next time it might be worth checking to see if you can call a solicitor for free.

At a guess this would be over the threshold for Section 75 (£100), might be worth going through your CC company? Might be difficult as regards their Ts & Cs but the change is so big it might work.

Have you considered naming and shaming?

As you have taken proper legal advice over this then that is likely to be definitive, rather than anything you get advised on a public forum!

I have done my level 4 with them and also my assessor training with them. When did you book ? There should be a cooling off period.

They are just being rotten, demand your payment back stating that you paid and chose a course that they are not delivering and they have changed the conditions themselves by changing the location, if you paid for something and it changes descriptions after that, then you have the right to tell them they are not delivering the service you expect.

Write a complaint and ask to speak to the head manager and explain the details to them and your predicament. Don’t let it go, keep fighting with them. I know that industry provider very well and if what you are saying is true then it is very unprofessional of them to make you pay for something then for them to change a key factor such as location.
