BW Legal/NCP letter of claim

Options
Hi All,
Really need advice/help I received a letter from NCP stating on the 2nd November i parked in Tamworth Gungate carpark without paying.... (this is 1 of those parking places where they use CCTV to clock in and out cars) anyway I knew what they was on about and I sent them a letter telling them if they look at their cameras they will see I was sat in the car in an 90% empty carpark with the lights on and I was only there to meet a friend to give him a power drill that he wanted to lend and I was there for only 15mins,
well after that I didn’t hear anything until a letter I got a couple weeks ago from BW legal saying they’ve basically took over the debt and I now owe them £160... I did call them explaining everything above to them but all they said was I should have payed and I owe them £160 other wise I would get taken to court and end up with a CCJ and he said to I admit liability and to what I said no I do not! Today I’ve received another letter saying I have 30 days to pay other wise would have more cost on top with an estimate of £239.91 on the letter or object within 30 days with a selection on about 5 different options. Really need help on what to do or what to say to them when replying? Thank you very much in advance.

    Stop phoning scammers.

Read the NEWBIES PLEASE READ THESE FAQS FIRST thread, ONLY the 2nd post of it, which tells you about sending a SAR to the parking firm to 'see their hand' before court stage. And that thread talks you through how to win at court stage.

Well, you must respond to this

Just to get this clear for you, BWLegal cannot issue a CCJ, only a court can do that and that's only if you lost. Very ignorant and arrogant to talk to you like that .... that's BWLegal ????

You don't owe £239.91 because BWLegal are trying to scam you for £60 .........

    BWLEGAL ADD ON A FAKE £60 ?
In addition to the 'parking charge', the Claimant's legal representatives, BWLegal, have artificially inflated the value of the Claim by adding costs of £60 which has not actually been incurred by the Claimant, and which are artificially invented figures in an attempt to circumvent the Small Claims costs rules using double recovery
    . >>>> thanks to bargepole

Did BWLegal provide you with proof of their claim, pictures, proof of the amount claimed etc. You can ignore the forms

You now need to rebut their claim so what are you going to say ?
  • They said if I don’t pay I will get taken to court where I would likely get a CCJ...
The price is £160 but if I get taken to court there will £79.91 of additional fees on top they stated on the letter.

Yes he was very annoying little know it all whipper snapper on the other end of the phone.... every time I said I was in the car sat there for about 15min he would talk over the top of me and say it was actually 16mins!

No they didn’t send me proof but 1 of the options on the reply form is to request proof.

I’m not to sure what to say back to them :(
  • Hi,
Have you link to it as I can not find it? Sorry I’m not very good with all this kind of stuff :(

Well, the first thing is never phone them, if they want to employ whipper snappers ... that's there problem

You rebut their claim and request proof by way of pictures and proof of the monies claimed.

It is obvious that BWLegal are well out of their depth in the great parking scam

They are so uncouth, they might not even reply but the clue is that the less they tell you, the better for you.

Play the game with this unprofessional bunch and come back here if it goes further ..... they can be zapped and then you can claim your costs against them

So they now know who the driver was. That's a shame.
