County Court Defence

Please help

In the process of defending a county court claim for Parking in a private car park with no valid permit displayed.

I have completed the Acknowledgement of service, but struggling with the defence.

There was no ticket attached to windscreen and didnt receive a NTK - all was received were the BW legal letters, which were ignored, then the letter before claim from Gladstones.

I have done a SAR to Gladstones and also the original parking company JD Parking consultants.
I have received the SAR back from Gladstones but nothing as of yet from JD parking.
There is no copy of the original NTK from JD on the SAR request from Gladstones.

I am struggling with defence. i have now though managed to see the pics of the vehicle parked via the Parking collection services website after a little investigative work.
There is no copy of the Notices/ signs from the car park, which would clearly show if any breach of contract was allegedly made.

Help please as i need to complete the defence on the moneyclaim website ASAP

    Example defences are to be found in the NEBWIE section post # 2 written concisely by Bargepole. Pick the one that most nearly fits your circumstances. There is one where the first or second point states that the "defendant reserves the right to submit a modified defence upon receipt of correct and full Particulars of Claim" (POC). This should help whilst you wait for the results of you SAR submission.

    DO NOT submit your defence by MCOL, instead use the following method as advised by KeithP: -
    When you are happy with the content, your Defence should be filed via email as suggested here:
    1. Print your Defence.
    2. Sign it and date it.
    3. Scan the signed document back in and save it as a pdf.
    4. Send that pdf as an email attachment to [EMAIL="CCBCAQ@Justice.gov.uk"]CCBCAQ@Justice.gov.uk[/EMAIL]
    5. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    6. Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
    7. Do not be surprised to receive a copy of the Claimant's Directions Questionnaire, they are just trying to put you under pressure.
    8. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.
