BW Legal/ Britannia Parking Fine

Hi All,
I have read a few posts regarding BW Legal, before i go forward with my case with them (they have now submitted a money claim). I just wanted to know if i stand any chance at all...
The issue:
Parking fine sent by Britannia Parking - who sent letters via various different companies to try and claim the parking charge.
Why are they claiming:
I didn't pay for parking
What happened:
I went into an empty multi story car park around 9pm to put oil in my car as it was going to break down and then left the car park.
Now I'm not sure if i can defend this, any help is much appreciated
Regards
Eddie

Hi and welcome.
Yes you can defend this.
You seem to be saying that you have received a County Court Claim Form from the County Court Business Centre in Northampton.
Is that right?
If so, please tell us the Issue Date on that Claim Form.
You now need to be reading post #2 of the NEWBIES FAQ sticky thread to better understand how you are going to deal with this.0 -

You should have pulled over on street and as long as you avoided bus stops, taxi ranks, residents bays (and red routes if in London) you'd have been fine. Even on a yellow line or double yellows this would have been OK, as long as there were no kerb blips. If you'd got a Council PCN, evidence of a breakdown would have likely cancelled it and you'd have had no court case.
I make it my mission to stop people seeking out poxy car parks all the time, avoid them like the plague in future, you DO NOT need to come off the street and put yourself through this scam. Just don't drive into private car parks at all - or if you do, cover your numberplate (ever thought of that?).
Anyway, we hope you have at least read NEWBIES PLEASE READ THESE FAQS FIRST and done the AOS, as per the second post there? Everyone can defend these scams, and even if you lost it would mean you'd likely pay less than the claim! No CCJ, no risk, may as well fight.
But next time, just avoid car parks, they are not the place to seek out.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
