    How would an Apple "engineer" be called to Court over a John Lewis dispute? The answer is that the OP could not use such "hearsay" evidence

    But in your experience the accusation you made was against the company concerned!

    I wasn't talking about the engineer being in court. No, you can't use hearsay unless it is admitted. It's irrelevant who the accusation was against - if it's admitted then it's admitted. If the engineer told JL what he'd said to the OP and they admitted as much, then it would count as evidence.

    OP you need to speak to John Lewis, I cant fault the after service Ive had from them, both times the item was replaced no questions asked.
  • It's certainly worth quoting the Apple guy in regards to your product, what's there to lose?
    I once had a large format printer (Quite an expensive one) that was outside of it's warranty by a good few months. I spoke to a techy at the retailer who said that it shouldn't have failed so soon, I also spoke to someone at Epson who said the same.
    Based on my statement the retailer agreed, albeit begrudgingly to replace the printer with a new one.
    It's well worth giving it a shot, alternativly you could perhaps email Apple and ask how likely it is for the logic board to fail in the time you've had it, atleast then you would have something in writing.
    Just because something has an XX Year warranty doesn’t mean that after that it should fail.
    Like I said it’s certainly worth quoting the guy when you speak to JL.

    It's an observation of forums that users who have been around a long time do not like new users and even mentioned in the forum rules of this website, so it's obviously quite common. It has only been older users who have been attacking or criticising my posts and advice. One of these same users (Andy) commented on a new user's post on another thread purely to say: "Thanks for joining up just to post this". Can it get more obvious?

    As with everything in life not everyone will agree with what you say. They disagree with how your interpreting the consumer rights act, doesn't mean the posters on this thread don't like new posters.


    You can report posters if you feel they aren't being polite/not following the "MSE requests you give new users a chance! Please be especially nice."


    But lets not detract from the actual thread which is about an iMac.

    You need to understand how this evidence works. It's faulty, we all know it's faulty, it should last more than 3 years, we all know it should last more than 3 years.


    An Apple rep saying this doesn't make it evidence. It's why the board is faulty that counts. There needs to be an expert willing to say the fault is due to an inherent fault due to poor workmanship when it was made.


    Apple do not provide these reports, they never have and never will for obvious reasons.


    There are numerous reasons the board could be faulty, an inherent fault is only 1 option. This is why the expert report is needed.

    With all due respect it's not about disagreeing. We are meant to be posting to help people who are asking questions, putting someone down and saying they don't know what they're talking about isn't nice OR helpful. I've had comments that are purely to criticise me and not to help the OP. I have reported people, but then suddenly I got banned because I'm supposedly the same person as Plagueangel!! And I'm not supposed to be angry about this?!

    Maybe not to the person giving the incorrect advice. It is to the OP though, who came here for information on their consumer rights and not just opinions on what we think their rights should be.

    There are things the regulars here disagree on - in fact, I'm pretty sure I've disagreed with every single one of them at some point (some more than others though :D) and they've disagreed with me. As much as I hate feeling like I'm constantly contradicting people, I still do it because I'm here to try and help people with their consumer rights, not make friends. But there comes a point where even I realise we're going round in circles and therefore its a waste of time for all involved. Much like now how we're all discussing your issues instead of the OPs.

    You can also be sure that when regulars are unanimous in their opinions that its because its a basic of consumer rights that we're all familiar with and less open to opinion than some other matters.
