So if you don’t update your address when you move (or otherwise, especially if you’re purposefully avoiding debts) and the lender and/or court doesn’t attempt to track you down then that’s fair game to have it set aside?
The old case used to be that CCJ's were issued to "the last known address", creditors didn't check and even when they were informed by new occupants that the person "no longer lived there" they still went for CCJ and then afterwards started tracing to find current address. This led to a lot of set asides being granted. The courts do not like their time being wasted, and so MOJ put in changes, just like when the old Letter Before Action was beefed up to Pre-Action Protocol to try and reduce the number of claims forms issued. Creditors now have to do some rudimentary checks.
Of course this does not mean they need to go and chase down the person and find their current address, just that the creditor can show the debtor has connections to the address they are wanting to issue legal proceedings to. Not sure what exactly the minimum would be but usually a check of their credit file which will suffice.0 -

Well I attended court today and the good news is that the judge agreed with me in that Crapquest had acted unfairly and not given me any chance to settle and set aside the ccj😁😁
The judge did say that I had 2 weeks to settle an agreed amount so when I got home I called crapquest to pay and the cheeky sods had added £20 which they said was a legal charge😢 Just to draw a line and get them off my back I paid it.
Do I now have to inform the court that I have now paid and if do hie do ai go about it?

I have thus week also settled crapquest amount do the ccj should now go within the next month ����0 -

Can I ask on what basis you applied for, and were granted, a set aside of teh CCJ, particularly in view of the fact you appaer to have since settled the amount claimed as owed?0 -
