I would definitely still ask the court to enforce judgement. They're still at the same address right? I don't think you can send in bailiffs until a certain amount of time has passed and after you've asked the court to enforce judgement.

By the way, how did you pay for the car?

How much is the judgment for?
  • Thank you to everyone who has replied I really do appreciate it.

The car is on finance and the judgement is for the value of the car plus court fees. Around £3500

You may want to consider the High Court then. There are companies out there (such as the one on Can’t Pay We’ll Take It Away) that will do all the leg work and calculate the interest etc.

They charge £60 to elevate the matter to the High Court and get the writ, they then charge £75 plus VAT if they are unsuccessful. If they are successful they recover your £60 for you and they recover their own fees from the debtor.

From my experience High Court enforcement is far quicker and get better results than County Court baliffs.

For that debt you can uplift to the High Court. High Court enforcement tends to be more successful as they get paid by results whereas baliffs get paid no matter what.

There is a fee for this so again your call. If you take the view the money is lost then you can weigh up how much causing him grief is worth.

Have you paid off the credit or are you still doing so? And who is the agreement with?
  • I didn’t realise about the High Court, thank you very much for that information.

No I’m still paying it off, it’s a company called Motonovo Finance

Motonovo aren't any affiliation to the people you bought the car with then? Is it possible they could help you recoup the money if you can't get it back from the seller? Do they have any sort of protection like this like with debit cards and credit cards?

This is the bunch off BBC https://thesheriffsoffice.com/

and this lot take it away if you can't pay https://dcbltd.com

    Other companies are available.

Whilst I don't rate their chances of recovering anything they will cause the guy a headache. They are pretty persistent if they think they might get something.

Why didn't you raise a Section 75 claim against the finance company?
