Won Small Claims...now what?

Hi,

Around a year ago I bought a car that was sold faulty. Went through all the correct process as advised by CAB. It finally went to Small Claims on the 6th March and I found out I won on Thursday. The garage have to pay me my money back and collect the car by the 12th April.

However the garage no longer exists according to the internet and it looks like they have reopened under a new name (they have done this repeatedly). According to the FCA website they are no longer authorised as of the 19th March.

What are the chances of me actually getting my money back?

    My best guess is about no chance. I bet he's done this before and is adept at dodging his debts.

    What was the company name? You said they weren't ltd so was it a sole trader? I,e Joe Bloggs trading as xxx cars.


    If it was then you chase Joe blogs for the money.

    No hope then. If the company doesn't exist anymore then enforcement is next to impossible. Like I said earlier he's done this before and knows how to play the system.
  • It was a company name Xxxx Autos. But definitely not a LTD company. I have called the new company today and the same owner answered. So it’s not worth asking court to enforce the judgement if he doesn’t do anything by 12th April?

    You can hold the owner personally liable as they are not Ltd. Send in the bailiffs.

    Given it costs relatively little to send baliffs it might be worth a try but frankly I don't rate your chances.

    I hate to say but it's your call really.
