I don't see how the freeholders could in practice sort it out without involving both the leaseholders. And not sure that they have a duty to, though I would guess this would constitute some technical breach of both leases if they choose to enforce them.
Have you got landlord's contact details so you can chase up direct?0 -
Can I request my freeholders to put it right? Do they have a duty to put it right? (Freeholders is a trustee, and managing agent makes all the decisions on their behalf.)
Check the wording of your lease.
Often it will say that you can ask the freeholder to appoint a surveyor to decide on a dispute between leaseholders - and you will be bound by the surveyors decision.
However, that's likely to be expensive.
The surveyor might also decide how the costs should be split between leaseholders - based on 'blame'. (So you should make reasonable efforts to solve this by other means first, and be pretty sure that you're 'in the right'.)
But maybe your freeholder will do something informally - but freeholders often still tend to expect to be paid for anything they do.0 -
I don't have the LL's contact, our managing agent has it but can't give the LL's contact details without their consent.
My lease has said leaseholder are responsible for the cost of surveyors, but I think it's too expansive so trying not to go there.
I was thinking if the freeholder has granted me the exclusive right to use that space (as per wording in the lease), the least they can do is to swap the number plate back. I will then get locksmith to open the locker and change the lock (with several notices to the LL and freeholder in advance stating my intents). After all, I am only accessing my space, right?0 -
I would contact the leaseholder direct. So, we have waited until last month to get on with this issue. They can't exchange the key with us because they are renting. I've asked managing agent to pass my details to their landlord and I've not heard back from the LL at all.
Assuming the LL is not reachable or just can't be bother to deal with this. Can I request my freeholders to put it right? Do they have a duty to put it right? (Freeholders is a trustee, and managing agent makes all the decisions on their behalf.)
Ask the tenants for his contact details?
Try the letting agent if there is one?
See if the Land Registry has his address?
Write to him at the flat and see if Royal Mail forwards a letter?
A straight swop arranged between leaseholders will be much easier and cheaper than involving freeholder, managing agent, surveyor etc.....0
