NTK required after appealing NTD?

    I have only a screenshot of the appeal and rejection, and as I can't attach files here I won't write it out. I'll take my chances with looking foolish.

    I’m making no assumptions about you. That post was non-personal, rather an observation of how the land lies right now. Any ‘you’ was not directed at you, think more a ‘royal you’.

    I was not lecturing anyone, but if anyone reads the post and understands its intention and saves themselves the hassle of a PCN and a grab for £100 of their cash by reading the signs and complying, while we’ll never know of them avoiding a PCN, if we did, it would provide even greater satisfaction than getting someone off their £100 PCN, as it would be hitting the PPCs at first base.

    People just aren’t getting the threat that faces them virtually every time they take their car out, as almost all end up parking somewhere .... and on any private car park, it is now shark-infested water. We deal with more than 100 separate cases every day, and the number increases as more and more motorists are ending up in the county court, being sued for £250+.

    We are not a parking anarchy board, we never encourage or condone fly-parking, but even the worst ‘offenders’ will always find and receive some help and advice from the small number of volunteers (yet total strangers to them and their personal problem). Sometimes it’s a bit blunt and to the point, but it’s always aimed with the best intention of getting them off their parking penalty.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Sounds like it will be an easy one to win as long as no NTK arrives. Will you get to day 56 after the parking event, before the POPLA code/rejection letter is 32 days old (POPLA codes last 32 days, not only 28)?

    That's where you need to be - past day 56 with no NTK, but not missing the POPLA deadline.

  • That's fine. I'm with you on "not feeding the sharks" - it would be so much easier and cheaper for me to pay 40/80 quid and be done with it.

    It did give the impression of being a lecture somewhat, despite me prostrating myself to the forum!

    But point taken/reinforced.

    The POPLA Code will last for 32 days, despite the official deadline being 28 days. We have seen enough appeals go through at the 32 day point without being timed out to be confident in our advice.

    It’s only an easy win if the driver was not revealed in the NTD appeal. The OP said they sent a modified form of the standard template for some reason known only to themselves. They have not seen fit to show us their appeal so we are in the dark. I think it’s very likely that they outed themselves as driver with careless use of pronouns.

    We don't care, please don't repeat that...people say this all the time and we put them right all the time... I was trying to avoid this discussion again. Hence why I was at pains to tell you it lasts 32 days NOT 28, in the hope you would see that I have explained the difference and wouldn't talk about what the POPLA website says, as if we don't know!

  • Hah. Ok, I'll take your word for it. :-)

    The NTK deadline is when the POPLA code hits 30 days, so looks like I need to stick in the appeal on day 31.

    I did not imply who was driving in the appeal. The words in that respect were "as keeper of the car".

    I will never again speak of the number that is below 29.

    Nigel: I appreciate you don't have much confidence in my competence in this area, but for this purpose is it enough for you guys to take my word for it? Do you have a particular skin in the game wrt whether I win at POPLA or not? I ask because otherwise it's fair for me to say "don't worry about careless pronouns; if I lose it's on me". Would my losing adversely affect you guys/everyone else?
    I did state that I wasn't uploading the appeal itself because I don't have it in text format. For no other reason.
