NTK required after appealing NTD?

I stupidly appealed an NTD from CPP (I didn't say who the driver was), and as such am outside the recommended appeal practice detailed on this forum.

Are they still required to issue an NTK if the NTD has been appealed on their website?
They provided me the POPLA code. What route should I take to get them to go away?

    Well a driver normally appeals a NTD unless it is stated that they are not the driver in the appeal...

    A PE NTD is a rare occurrence so what are the details of issuing? Where and why for starters.
    What was said in your appeal and what was PEs response?
    Don't say who the driver was please and maybe amend your first post.
  • Sorry, it was actually CPP. I got confused because I gather they're one and the same now.

    Sainsburys car park. Driver left it there 10mins to get a prescription, didn't pay for a ticket and was unlucky.

    The appeal was pretty much along the lines of the template on this forum, which is focused actually on NTK, and as such I think some of it may not apply.

    Standard advice is to wait for the NtK, no? As that's the one they usually screw up in terms of technicalities.

    In any case, I'm wondering if I should wait for an NtK or do they not need to send one now that it's been appealed?

    if a driver has not been divulged , they need to issue an NTK between day 29 and day 56 for keeper liability to apply

    but if they issued a popla code in the meantime, ensure any popla appeal is uploaded by day 32 , regardless

    Most of these tickets are scams and Parking Eye signs are not up to snuff.

    All their signs that I have come across fail imo to be able to form a contract. They are either too high, the font is too small, or they are too wordy, or all of the above, read this thread and complain to your MP.

    On 18th March 2019 a Bill was enacted to curb the excesses of these private parking companies. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.

    Until this is done you should still complain to your MP, citing the new legislation.

    Please amend your initial post to reflect the correct name of the scammers involved.

    The scammers don't "need" to send a NTK, and it is to your advantage if they don't.


    If you have a PoPLA code, use it. The NEWBIES tells you to do this, and post 3 of said NEWBIES has a whole raft of template appeal points ready written for you.

    Use all the points that are relevant.

    First though, complain to the store manager and/or CEO, which the NEWBIES also tells you to do.

    Also complain to your MP about this unregulated scam, pointing them towards the new parking act and the comments in red from post 1 of the NEWBIES.

    I doubt Sainsburys are going to be too helpful to a non-customer, ticket non-payer, chancing his luck in using their car park to shop elsewhere.

    Maybe the very kind of reason that Sainsburys had to get a PPC onto their car park?

    Fruitcake: Yes, I did read that a while back (it's long!) and my original Q is really about which of these points I can use in an NTD rather than an NTK scenario, as most discussion is centererd around NTK. I'll re-read though, as I know it's tiresome going over old ground with noobs.

    Umkomaas: I take your point completely; one might see it as slightly cheeky. I guess in mitigation though, if you're otherwise a regular customer of Sainsburys etc etc...

    RedX: I have 28 days from the date of appeal failure to appeal to POPLA, so I will do that towards the end of that period.

    Pretty much? You sent the template or you didn't?
    You didn't seem to know the PPC , so unless you show us what your appeal actually said and the actual rejection from CPP, then a POPLA appeal could end up looking foolish....

    But you're running out of road on that. Private parking companies are pushing down roots on every private car park not already having one in situ. They are blocking off all escape routes.

    Read the signs and comply, and the parking companies will wither and die. Ignore the signs and not comply and you'll be dipping into your pocket for £100, and parking companies multiply.

    And they are currently multiplying at a rate as motorists still think it's their God-given right to park anywhere, anyhow and anytime they like!

    Over 7 million private parking penalties have been issued in the past 12 months. Over 1 million up on last year.
