does this 12 month rule apply where you obtain backdated PIP after a reconsideration and the person is on income related ESA? can you please provide a link to the authority for this please as I cannot find anything , also do you still need to declare it even though it is disregarded for 12 months ?many thanks
Yes, it's disregarded for 52 weeks. The reason is because you should have been paid that money in the first place. I'm afraid i can't find a link, sorry. Others may help, if they see this.0 -

Hi,
Today I received about £1500 in the bank and a letter saying they had paid the amount in and it was for a 6 month period between 2012 and 2013. It works out at about £68/£69 a week for the time period.
There was no explanation as to how they came to that figure, just a paragraph saying if I want to know more to get in touch with them at the number at the top of the letter.
Called that number and 5 minutes of automated messages and button pushing and a further 25 minutes on hold, I got through to someone who told me I need to call another number. Gave me the number and put me through and after listening to the recorded message I pressed 1 for an enquiry and recording told me to ring the 1st number I called and then hung up on me.
Called back and got through to someone who I couldn't fully understand but he seemed to think I was getting income based ESA since later in 2013. I don't remember being told I had been switched to that from contributions based and I brought up with him that I have been paying council tax all the time which you only do on contributions based and not income based. I know that has recently changed and is different by council but I was told I had to pay council tax before because I was on contributions based.
I asked if I could have a letter of their calculations to run by the CAB and he said I should get a letter. Told him I had one just saying an amount is being paid and the dates its for and nothing else and he seems to think that was the one I expected. Reiterated that it had no breakdown at all except a date period but he wouldn't send me anything in writing to take to the CAB. He told me to find out what they would need and get back to them. Not helpful at all.
Family are asking if there should be a single person payment as part of it and if the disability payment is the same disability payment. I don't remember getting a disability premium from the start or for the full period the form covered. Really confused and without a breakdown to take to the CAB im not sure if their calculations is correct or not.
I'm £1500 better off than yesterday but have a feeling it's not quite right and the lack of printed statement explaining their working has added to that feeling!0 -
It sounds as if you may have received a Severe Disability Premium for the period in question.
It’s not possible to comment in more detail without knowledge of the history of your ESA claim and what other benefits you are/were receiving and whether or not you were living alone.Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.0
