Doorstep visit from Resolvecall

Hi,

Looking for a bit of advice please.

On Saturday just gone (16th) I received a letter from "Resolvecall" stating that they had been instructed by "Lantern" to make a doorstep visit to my address and would do so after 7 days.

Yesterday (20th) sure enough, I received a hand delivered note through the door from Resolve call saying that they had visited for the 1st time and they're saying I've to call their head office.

I've gone through some unopened letters from last few weeks and there is indeed a debt letter from Lantern stating that I have a debt for around £1500 owed to Sunny&More?

I don't recall a debt for this amount, however if it is what I think it's for then I probably do owe it, but the amount was nowhere near £1500.

Any advice gratefully appreciated.

  • As mentioned above, get a credit report (free from Noddle) to ascertain who the originating company is.

    If you genuinely have a default, you will need to act on it to avoid having a CCJ awarded against you. Debt collection agencies can still add charges to your debt for each time a debt collector comes to visit, but these are not supposed to be excessive compared to the costs they have incurred in getting to you.

    If it's not your debt, then the "prove it" letter (someone else will provide the link) is a good place to start.

    If it was a payday loan, interest can be added right up to the point of default.

    DC can charge fees, do you think that they work for free.
    Just came out of a problem with my Council, debt was sent to debt collection and fees were added.

    I assume the prove it letter gets them to respond with proof of the debt and with a breakdown of the balance?

    If I may ask, has someone got a link to that prove it letter please and can I send it by email to the company?

    Also (sorry for all the questions) do I not send anything to Resolvecall/contact them at all? Just Lantern?

    Doesn’t mean you have to pay them, you have no agreement with the DCA at all, unless your original agreement states debt collection fees can be charged, they are just trying it on, they would be unenforceable in court, it amounts to an invoice they are sending you, if you pay it, that’s your problem.

    Always check the small print of your agreement.

    sourcrates has already given you a link to the proveit letter in his last post. It must be sent by Royal Mail direct to Lantern (an email is not satisfactory).

    No not at all, as I said, they are just self employed collectors, absolutely no power whatsoever, just tell them to go away, as you are dealing with Lantern directly.

    Exactly this. OFT guidance notes for debt collection para 3.11 footnotes:

    "The Consumer Credit (Agreements) Regulations 2010 require the agreement to include a
    statement of 'any charges payable for late payment' and 'any other charges deriving from
    the credit agreement and the conditions under which those charges may be changed' "

    Looking at the T&Cs for my remaining credit cards online, both organisations grant this provision - I would think it a rare that a CCA doesn't.
